The official Polish name of the document is zaświadczenie o niekaralności. Although it is commonly called a Police Clearance Certificate, it is not issued by the Polish police. The information comes from the Krajowy Rejestr Karny, Poland’s National Criminal Register, which operates within the Polish justice system.

When Is a Police Clearance Certificate from Poland Needed?
A Police Clearance Certificate from Poland is normally required when an authority outside Poland needs official confirmation of your criminal record status.
This often applies to people who previously lived, worked or studied in Poland but have since moved to another country. Even if you left Poland several years ago, an immigration authority, citizenship office, consulate, employer or professional body may ask for a police certificate covering the period of your stay.
For example, if you previously worked or studied in Poland and now live in Canada, the Canadian authorities may require a Polish Police Clearance Certificate as part of an application for permanent residence or citizenship. A similar requirement may arise when applying for immigration in the United States, a visa in another country, British citizenship, international employment or professional registration.
A Non-Criminal Certificate in Poland may also be required for work permit procedures, employment and background checks, regulated professions, university applications, or court and administrative proceedings abroad.
Both Polish citizens and foreign nationals can obtain the certificate. You do not need to be a Polish citizen. If you lived in Poland and an authority in another country requires criminal record information covering that period, the relevant document will normally be a certificate issued using information from KRK.
In practice, when a Canadian, American, British or another foreign authority asks someone who previously lived in Poland for a “police certificate from Poland”, it will normally be referring to criminal record information obtained from the Polish National Criminal Register.

Apostille and Sworn Translation
The main service is obtaining the official paper Police Clearance Certificate from the Polish National Criminal Register. An apostille and sworn translation are additional services arranged only when required by the authority that will receive the certificate.
If the KRK certificate will be submitted outside Poland, the receiving authority may ask for an apostille. An apostille confirms the authenticity of a Polish public document so that it can be used abroad under the Hague Apostille system. It does not change the contents of the Police Clearance Certificate and does not add any criminal record information.
An apostille is not required in every case. The requirement depends on the destination country, the purpose for which the certificate will be used, the instructions of the receiving authority and the applicable international framework. For a Polish criminal record certificate, the apostille is handled by the Polish Ministry of Foreign Affairs, not the Ministry of Justice.

Legal Information
Information from the Polish National Criminal Register is governed primarily by the Act of 24 May 2000 on the National Criminal Register (Ustawa z dnia 24 maja 2000 r. o Krajowym Rejestrze Karnym).
Article 7 of the Act provides the legal basis for an individual to obtain information on whether their personal data are contained in the Register. Polish law also allows information from KRK to be obtained through an authorised representative when the required documentation has been prepared correctly.
Official criminal record certificates are obtained through KRK information points operating at Polish district and regional courts.
If you are physically present in Poland, you may prepare and submit the application yourself, collect the certificate and separately arrange any apostille, translation and delivery.
