Inheritance Power of Attorney

Preparing an inheritance power of attorney when an heir cannot personally appear before a notary or office in Poland

Inheritance power of attorney with a Polish notary in Wrocław

ONE PLUS prepares powers of attorney for inheritance matters in Wrocław for the actual stage of the case: dealings with a notary, permitted representation, obtaining documents, bank and tax matters, registry filings and actions concerning inherited assets. We do not use one generic “everything” template. We first establish where the succession is being handled, what has already been completed, what the representative must do and what the receiving notary, court, bank or authority requires.

A Polish notary attends at our office in Wrocław. The client receives a draft and a list of information to check before the appointment. Where the wording has been agreed in advance, signing the completed document in a straightforward case usually takes around 15 minutes.

Inheritance matters are particularly sensitive to the scope and form of authority. Obtaining a bank document, filing with a registry, appearing in court and making a declaration accepting or rejecting an inheritance are different legal acts. Some steps have a special form requirement, and court representation is subject to rules about who may act as a procedural representative.

Where the POA will be used outside Poland, we recommend considering an apostille for the Polish notarial document in advance, particularly for a cross-border inheritance matter. This helps prepare the document for international use before it is sent abroad. Poland and Ukraine have a bilateral legal-assistance treaty under which official documents are recognised without legalisation, so the final requirements should be confirmed with the receiving notary or institution. Even so, for cross-border inheritance matters ONE PLUS recommends considering an apostille as a practical additional authentication of the Polish document.

For other countries, ONE PLUS can coordinate Apostille Services in Poland and document translation where required.

When is an inheritance power of attorney useful?

A POA is useful where an heir cannot personally deal with every part of the succession and wants another person to carry out defined tasks.

A common situation is an heir living in Poland while the inheritance is being handled in Ukraine or another country. The reverse also occurs: the estate is in Poland but the heir is abroad or cannot repeatedly attend a notary, bank, court, registry or public authority.

Depending on the procedure and wording, the representative may obtain records, submit applications, contact a notary, deal with a bank, collect correspondence, make registry filings and perform other specifically authorised steps.

The purpose is not to grant the widest possible powers. It is to give the representative the authority actually required for the case.

A POA does not itself prove inheritance rights

A power of attorney and proof of inheritance are different documents.

The POA allows a representative to act for an heir within the stated scope. It does not itself determine who inherited the estate and does not replace a court decision, a Polish registered certificate of inheritance, a Ukrainian inheritance certificate or another document required by the applicable succession procedure.

We therefore establish whether the POA is needed before inheritance rights have been confirmed, during an existing proceeding or for later dealings with assets after the heir’s title has been established.

Accepting or rejecting an inheritance through a representative in Poland

Polish law contains a specific rule for authority to make a declaration accepting or rejecting an inheritance.

The declaration may be made before a court or a notary. If a representative is to make it, the power of attorney for that act must be in writing with an officially certified signature.

A broad phrase such as “represent me in all inheritance matters” should therefore not automatically be treated as a substitute for authority drafted for this particular declaration.

As a general rule under Polish law, an heir has six months from learning of the basis of their entitlement to make a declaration accepting or rejecting the inheritance. If no declaration is made within the applicable period, the general rule is acceptance with the benefit of inventory.

If acceptance or rejection is the purpose of the document, tell us before drafting.

Power of attorney and the Polish notarial inheritance procedure

A Polish notarial certificate of inheritance follows its own statutory procedure.

Before issuing the certificate, the notary prepares an inheritance protocol involving the interested persons, subject to statutory mechanisms that allow a draft protocol to be prepared and relevant persons to confirm its contents in separate notarial statements.

This means that a broad POA should not be described as automatically replacing every personal statement required from an interested heir.

If the notary who will handle the inheritance has already been selected, obtaining their document list and procedural requirements before signing the POA is useful.

Power of attorney for an inheritance court case

Court proceedings require additional care.

Not every person named in an ordinary notarial POA is automatically entitled to represent a party before a Polish court. The Polish Code of Civil Procedure identifies categories of persons who may act as procedural representatives, including advocates, legal advisers (radcowie prawni), certain relatives and other persons who meet statutory conditions.

If the document is intended for a court proceeding, provide the name of the court, the type of case and the intended representative. The drafting should match the procedural task rather than simply adding the word “court” to a generic list.

Bank accounts and deposits are often a separate part of an estate.

The bank will normally require documents establishing the heir’s rights. A POA granted by the heir does not replace the document proving succession where the bank requires one.

A representative may be authorised to submit inheritance documents, obtain information to the extent permitted, file applications, collect funds due to the heir or perform other actions accepted by the particular bank.

Banks have their own internal procedures, so it is useful to obtain the bank’s requirements before the POA is signed.

Power of attorney for inherited real estate

After inheritance rights have been established, an heir may need to register ownership of an apartment, house, plot of land or share.

The representative may need authority to obtain extracts, file registry applications and deal with documents connected with the property.

If the representative is later expected to sell, gift or otherwise dispose of the property, that is a separate transaction. Real-estate transactions can have special formal requirements for the POA.

For that reason, a right to sell or gift property should not be added automatically to every inheritance POA.

What authority can be included?

Depending on the case, the representative may be authorised to:

– deal with notaries; – obtain certificates, extracts, copies and duplicates; – make archive requests; – deal with public and local authorities; – file applications with registries; – obtain documents relating to real estate, land or vehicles; – deal with banks in relation to inherited assets; – submit tax documents where representation is permitted; – receive decisions and correspondence; – complete registration steps after inheritance rights have been established; – act in court where the representative satisfies procedural requirements; – make a declaration accepting or rejecting an inheritance where the POA has been specifically prepared in the required form; – perform other clearly defined inheritance-related acts.

Not every case requires all of these powers. An overbroad document can be just as unhelpful as one that is too narrow.

Why a generic online template may fail

Inheritance matters differ significantly.

One estate may involve a single heir and one apartment. Another may involve a will, several heirs, bank accounts, a vehicle and court proceedings. A third may be cross-border and involve missing or inconsistent documents.

A generic template does not know the country handling the succession, whether inheritance rights have already been established, whether an acceptance or rejection declaration is required, who the representative will be, whether that person can act in court, the receiving notary’s requirements, the bank’s internal procedure or the assets involved.

The value of the document therefore lies in accurate scope, not in maximum length.

ONE PLUS starts with the actual procedure and then prepares the authority needed for it.

POA for an inheritance matter in Ukraine signed in Poland

A frequent situation is an heir living in Wrocław while the estate and inheritance procedure are in Ukraine.

The POA can be prepared and signed in Poland, but the wording should reflect the requirements of the Ukrainian notary or other receiving authority. If the notary has supplied a draft or a list of powers, send it before the Polish appointment.

Poland and Ukraine are parties to a bilateral legal-assistance treaty under which official documents are recognised without legalisation. Even so, for inheritance POAs intended for cross-border use, ONE PLUS recommends considering an apostille in advance.

Before signing, it is useful to obtain the requirements of the Ukrainian notary, bank or other receiving institution. If the institution confirms that no apostille is needed, the document can be prepared accordingly. Where the POA may be presented to several institutions or the requirements are unclear, an apostille can serve as a practical additional authentication of the Polish notarial document.

Translation requirements are checked separately.

POA for inheritance in another country

Other jurisdictions can have very different rules.

The destination may require a particular notarial form, apostille, consular legalisation, an official translation, specific representative details or a precise description of inheritance acts.

Tell us the country and the institution where the document will be used.

For POAs intended for use abroad, we recommend considering an apostille in advance where this is compatible with the destination country’s rules and the receiving institution’s practice. ONE PLUS can coordinate Apostille Services in Poland and document translation.

What information and documents are normally needed?

At the initial stage we normally ask for:

  • the principal’s identity document;
  • accurate details of the representative;
  • the deceased person’s details;
  • date of death where known;
  • information about the family relationship;
  • the will, if one exists;
  • details of any existing court or notarial proceeding;
  • the court, notary, bank or authority involved;
  • information about known heirs;
  • details of known estate assets;
  • requirements supplied by the receiving institution;
  • a clear description of what the representative needs to do.

You do not need to collect every possible document before contacting us. A short description of the case is enough to start.

Real estate, vehicles, bank funds and other assets

The type of asset affects the authority required.

Real estate may involve land and mortgage register documents and registration filings. A vehicle may require dealings with registration authorities. Bank funds involve the particular bank’s succession procedure. Company interests may require dealings with corporate records or registries.

If the estate contains several types of assets, tell us before the draft is prepared.

Missing documents and inconsistent personal data

Older inheritance documents can contain different spellings of names, incorrect dates, old addresses or incomplete registration information.

The representative may need authority to obtain duplicates, archive records, extracts and to submit applications connected with correcting data.

The POA does not itself correct an error or create a missing right. It authorises the representative to take the stated steps on the heir’s behalf.

Any known discrepancy should therefore be disclosed before drafting.

How the ONE PLUS process works

First, send us a short description of the inheritance matter.

We establish:

1. the country where the succession is being handled; 2. the deceased and the heir; 3. whether there is a will; 4. whether a court or notarial case has already started; 5. the known estate assets; 6. what the representative must do; 7. who the representative will be; 8. any requirements from the notary, court, bank or authority.

We then prepare the draft for the required stage.

After the personal data and scope have been checked, we arrange signing before a Polish notary at the ONE PLUS office in Wrocław.

Cross-border formalities are coordinated afterwards only where they are actually required.

How long does it take?

Where the task is clear, the information is complete and the draft has been agreed in advance, the signing appointment itself usually takes around 15 minutes in a straightforward case.

This does not mean that the entire inheritance matter takes 15 minutes.

Additional drafting time may be required for court-related authority, several asset classes, a foreign notary’s requirements, a special acceptance or rejection POA, translation or other cross-border formalities.

How much does an inheritance POA cost?

According to the current service description, the usual price is PLN 300–400.

The final amount depends on the complexity of the wording, the number of representatives, the scope of authority and any additional services.

Apostille, which we recommend for many inheritance POAs intended for use abroad, translation and other additional work are priced separately.

Why clients use ONE PLUS

An inheritance POA is more than a notarised signature on a generic document.

The practical question is what the representative will actually be able to do with it.

ONE PLUS:

– identifies the stage of the inheritance matter; – prepares authority for the actual institutions involved; – distinguishes ordinary representation from acts with special formal requirements; – arranges notarial signing in Wrocław; – takes cross-border use into account; – recommends and coordinates apostille for many inheritance POAs intended for use abroad, together with any required translation; – explains which issues a POA does not resolve by itself.

For broader authority, see our Power of Attorney in Wrocław and General Power of Attorney, Apostille Services in Poland and document translation.

FAQ

Frequently asked questions about inheritance powers of attorney
Can I arrange an inheritance power of attorney in Wrocław?

Yes. ONE PLUS prepares the POA for the specific inheritance matter and arranges signing before a Polish notary in Wrocław. If the wording and personal details have been agreed in advance, signing the completed document in a straightforward case usually takes around 15 minutes.

What can an inheritance POA authorise a representative to do?

The scope depends on the case. A representative may be authorised to obtain documents, deal with a notary and public authorities, file registry applications, contact a bank, receive correspondence and carry out other clearly defined tasks. Court representation, acceptance or rejection of an inheritance and dealings with real estate may be subject to additional requirements.

Can a representative accept or reject an inheritance in Poland?

Yes, but the authority for that particular act must satisfy specific formal requirements. A general statement authorising someone to act in all inheritance matters may not be sufficient. If acceptance or rejection of the inheritance is required, this should be stated before the POA is drafted.

Does a power of attorney prove that I am an heir?

No. A POA authorises another person to act on behalf of the heir, but it does not itself establish inheritance rights. Those rights are confirmed by the document required under the applicable succession procedure, such as a final court decision or a registered Polish certificate of inheritance.

Can I sign a POA in Wrocław for an inheritance matter in Ukraine?

Yes. If the heir is in Poland while the inheritance matter is being handled in Ukraine, the POA can be prepared and signed in Wrocław. It is advisable to obtain the Ukrainian notary’s or receiving institution’s requirements before the draft is finalised.

Do you recommend an apostille for an inheritance POA used abroad?

Yes. For inheritance POAs intended for use outside Poland, **ONE PLUS recommends considering an apostille in advance**. This is particularly useful in cross-border matters where the document will be presented to a foreign notary, bank, court or authority. The final requirement depends on the destination country and the receiving institution.

Does a Polish inheritance POA for Ukraine need an apostille?

Poland and Ukraine have a bilateral legal-assistance treaty under which official documents are recognised without legalisation. Even so, for a cross-border inheritance POA **we recommend checking the Ukrainian notary’s or authority’s requirements in advance and considering an apostille**. If the receiving institution confirms that it is not required, the document can be prepared according to that institution’s instructions.

ONE PLUS can coordinate Apostille Services in Poland.

Does the inheritance POA need to be translated?

It depends on the destination country and the institution receiving the document. An official or sworn translation may be required for international use. ONE PLUS can coordinate document translation together with the POA and apostille formalities.

Can the POA cover bank matters and collection of inherited funds?

Yes, where those powers are required. The representative may be authorised to submit inheritance documents to the bank, obtain information to the extent permitted, file applications and collect funds due to the heir where the bank’s procedure allows it. The POA does not replace the document proving the heir’s inheritance rights.

Can the representative deal with inherited real estate?

Yes. The POA can cover obtaining extracts, filing applications and completing registration steps. If the representative is also expected to sell, gift or otherwise dispose of the property, this should be addressed separately because special formal requirements may apply.

What information is needed to prepare an inheritance POA?

We normally need the principal’s and representative’s details, information about the deceased, family relationship and any will, details of the notary or court, information about known estate assets and a precise description of what the representative must do. Any instructions or draft supplied by a notary, bank, court or authority should also be provided.

How much does an inheritance POA and apostille cost?

According to the current service description, an inheritance POA usually costs PLN 300–400. The final price depends on the complexity of the wording, the number of representatives and the scope of authority. Apostille, translation and other additional services are priced separately. For inheritance POAs intended for use abroad, ONE PLUS recommends considering the apostille before the document is sent.
