Terms & Conditions
Updated: 28 September 2026.
These Terms of Use govern access to the ONE PLUS website, the use of its free features, the submission of enquiries and, where available, the remote ordering of paid services. They reflect Polish law and mandatory European Union rules. If a separate agreement or individual offer has been accepted for a specific service, that document takes priority in matters relating to that service.
1. GENERAL INFORMATION AND USE OF THE WEBSITE
1.1. Who operates the website
The website at https://www.one-plus.pl/ is operated by ONE PLUS Sp. z o.o., with its registered office at ul. Marszałka Józefa Piłsudskiego 43/7, 50-032 Wrocław, Poland. The company is entered in the Polish National Court Register under KRS 0000739695, NIP 8971857670 and REGON 380898127.
General enquiries may be sent to [email protected] or made by telephone on +48 71 880 85 08. Questions about personal data may be sent to [email protected].
1.2. Key definitions
- Website: the ONE PLUS online service available at https://www.one-plus.pl/ and its language versions.
- User: anyone who visits the Website, reads its materials, submits a form, books a consultation or orders a service.
- Client: a User who requests an individual service and enters into an agreement with ONE PLUS in the required form.
- Consumer: an individual who enters into a transaction for purposes that are not directly related to their business or professional activity.
- Electronic Service: a feature provided through the Website, such as viewing materials, submitting a contact form, requesting a call, booking an appointment or sending an enquiry.
- Individual Agreement: an agreement, order, accepted offer or other agreed document defining the specific scope of paid assistance.
Where mandatory Polish law extends certain consumer protections to a natural person entering into a business-related agreement that is not professional in nature for that person, those protections apply to the extent required by law.
1.3. Purpose and functions of the Website
The Website explains the services offered by ONE PLUS and provides ways to contact the company. Depending on the current technical version, it may include:
- information about services and procedures in Poland;
- articles, answers to common questions and practical guidance;
- contact and call-back forms;
- consultation or meeting booking;
- the submission of basic information for an initial assessment;
- payment, where that option has been enabled for a service;
- links to external communication tools, maps, social networks or payment providers.
Public materials can normally be viewed without creating an account. Available features may vary according to the Website’s technical version, language and selected service.
1.4. Electronic Services and technical requirements
To use the Website correctly, a User needs an internet-connected device, an up-to-date browser, JavaScript and cookie support and, for replies, a working email address or telephone number. The User bears the cost of their internet connection and telecoms provider.
An agreement for the free Electronic Service of viewing materials is made for the time that the relevant feature is used and ends when the Website is closed. Form submission is a one-off service and ends when the message is sent or when the User stops completing the form before sending it.
A User may stop using a free Electronic Service at any time by closing the page, not submitting a form or clearing browser data. Requests to erase a submitted enquiry or personal data are handled under the Privacy Policy, subject to applicable legal grounds and retention periods.
Normal internet risks include malicious software, phishing, data interception and messages impersonating another organisation. ONE PLUS does not ask Users to provide passwords for online banking or public administration portals through an ordinary contact form. Anyone unsure whether a message is genuine should verify it using the contact details published on the Website.
1.5. Acceptable use
Users must use the Website lawfully and respect the rights of others. In particular, Users must not:
- submit unlawful, abusive or misleading content;
- provide another person’s contact details without a lawful basis;
- impersonate another person or organisation without authority;
- introduce malicious code, interfere with the Website or bypass security measures;
- scrape data, overload forms, send spam or make mass automated requests;
- use materials in a way that infringes copyright, trade marks, personal rights or other protected rights;
- submit unlawfully obtained documents or ask ONE PLUS to take unlawful action.
ONE PLUS may stop handling an enquiry, block the technical source of abuse and preserve necessary evidence where this is required for security, the protection of rights or compliance with a legal obligation. This does not restrict the rights of a Consumer acting in good faith.
1.6. General information, not individual advice
Website materials explain general rules and typical procedures. They do not take account of every fact in an individual case and do not in themselves constitute personalised legal, tax or financial advice. Publishing an article does not create a representative relationship or mean that ONE PLUS has accepted a case.
Laws, administrative practice, forms, fees and processing times can change. The update date helps Users assess how recent a page is, but important decisions should be based on the current requirements of the competent authority or an individual assessment.
Information on the Website is not a guarantee of a positive decision, a particular timeframe or action by a public authority. Residence, employment, citizenship, registration and other administrative decisions are made by the competent authorities.
2. ENQUIRIES, AGREEMENTS AND DELIVERY OF SERVICES
2.1. Enquiries and formation of an agreement
Submitting a form, message, price request or call-back request normally invites further discussion. The enquiry alone does not oblige ONE PLUS to accept a case and does not always create a paid agreement.
Before an agreement is made, the Client is given the main characteristics of the service, its price or the method used to calculate it, payment arrangements, expected stages and any other information required by law. An agreement for a specific service is formed when:
- the parties sign an agreement;
- the Client accepts an individual offer and ONE PLUS confirms the order on those terms;
- the Client places a paid order through a Website feature that clearly states the obligation to pay and receives confirmation;
- the parties otherwise clearly agree the essential terms and confirm that work is to begin.
An automatic acknowledgement of a form confirms receipt only, unless it clearly states otherwise. Before an agreement is made, ONE PLUS may decline a new matter, for example because the required expertise is unavailable, there is a conflict of interest, a deadline cannot reasonably be met or the initial information is insufficient.
2.2. Individual Agreement and order of priority
The specific scope of work is set out in the Individual Agreement, accepted offer or order. It may specify stages, price, payment schedule, Client responsibilities, estimated timeframes, communication arrangements and rules for ending the engagement.
If documents conflict, they apply in the following order:
- mandatory law;
- the Individual Agreement and agreed amendments;
- the confirmed offer or service specification;
- these Terms;
- general information on a service page.
Marketing copy or an example of a typical situation does not automatically expand the agreed scope of a service.
2.3. Client responsibilities
To enable proper delivery, the Client must:
- provide complete and accurate information;
- supply legible, authentic documents that the Client is entitled to use;
- promptly report letters, requests, decisions and deadlines issued by public authorities;
- check personal details and prepared documents before signing or filing them;
- respond promptly and provide missing material;
- not withhold circumstances that may change the legal assessment;
- pay service charges and external costs when due;
- notify changes of address, telephone number, email address or relevant circumstances.
ONE PLUS may pause work where it cannot reasonably continue without necessary information, a document, signature, power of attorney or payment. The Client will be informed through the agreed channel. The consequences of a Client’s delay are assessed under the agreement and mandatory law.
2.4. Scope and delivery of services
ONE PLUS performs the agreed work with professional care. Depending on the matter, this may include analysing the situation, checking documents, preparing applications, arranging translations, assisting with correspondence, monitoring available case information and carrying out other agreed activities.
If an activity requires an advocate, legal adviser, notary, sworn translator, tax adviser or another licensed professional, ONE PLUS may propose working with an appropriate partner. The Client will be told who provides that part of the service and whether it involves a separate fee or agreement.
Representation before an authority is possible only where the legally required power of attorney has been granted. Payment for a service does not by itself authorise ONE PLUS to sign documents or make declarations on the Client’s behalf.
ONE PLUS working times are distinct from those of public authorities, courts, banks, translators, notaries, couriers and other third parties. A timeframe controlled by an external body is an estimate unless the law or the agreement expressly provides otherwise.
3. PRICES, BOOKINGS AND CONSUMER RIGHTS
3.1. Prices, payment and invoices
The price of a service is stated on the Website, in a price list, offer or Individual Agreement. Where an initial assessment is needed, the final price or the method for calculating it is provided before the agreement is made.
Before a paid order is placed, a Consumer receives information about the total price including taxes, known additional charges, the method of payment and when payment is due. Official fees, notarial costs, translations, delivery, partner fees and other external expenses are included in the ONE PLUS fee only where this is expressly agreed.
Payment may be made using the method offered for the specific order. An invoice or other sales document is issued under Polish rules. Late payment may lead to work being paused where permitted by the agreement and the law, without affecting Consumer rights that cannot be excluded.
3.2. Booking, rescheduling and cancellation
When booking a consultation, the Client should provide current contact details and a short description of the matter. ONE PLUS may request documents in advance if they are needed for a useful discussion.
Rules on rescheduling, cancellation and payment for preparatory work already completed are provided before a paid agreement is made or included in the individual document. If no separate rules have been agreed, mandatory Polish law applies, including Consumer rights relating to distance contracts.
If a meeting cannot take place for reasons attributable to ONE PLUS, the company will offer another date or refund the payment for the undelivered part in accordance with the law and the agreement.
3.3. Consumer right to withdraw from a distance contract
A Consumer who makes a distance contract or an off-premises contract normally has 14 days to withdraw without giving a reason. The period and statutory exceptions are set by the Polish Consumer Rights Act. Before the agreement is made, ONE PLUS provides the information required by law about how to exercise this right.
A clear withdrawal statement may be sent, including by email to [email protected]. A Consumer may use the statutory model form but does not have to do so. Sending the statement before the deadline is sufficient.
If the Consumer expressly asks for the service to begin before the 14-day period expires and then withdraws, the Consumer may have to pay a proportionate amount for the part completed before withdrawal. The right to withdraw from a service contract may be lost once the service has been fully performed, if performance began with the Consumer’s prior express consent and acknowledgement that full performance would result in loss of the right.
Any payment due for refund will be returned without undue delay and within the statutory period, normally using the same payment method unless another method has been agreed without additional cost to the Consumer.
3.4. Model withdrawal statement
To: ONE PLUS Sp. z o.o., ul. Marszałka Józefa Piłsudskiego 43/7, 50-032 Wrocław, Poland, [email protected].
I hereby give notice that I withdraw from the contract for the following service: [service]. Date of the contract: [date]. Name: [name]. Address: [address]. Order or contract number: [number]. Date of notice: [date]. A signature is required only for a paper notice.
Use of this model is optional. Any unequivocal statement clearly communicating the decision to withdraw is sufficient.
3.5. Complaints
A complaint about the Website or a service may be sent to [email protected] or by post to the company’s address. It is helpful to include the complainant’s name and contact details, a description of the issue, the date it arose, any case or order number and the requested outcome.
ONE PLUS may ask for clarification or a document where the complaint cannot otherwise be assessed. Complaints are considered without undue delay. A Consumer will receive a response within the period required by law, normally no later than 14 days, on paper or another durable medium.
Making a complaint does not remove any other remedy available to the Client under the law or an Individual Agreement.
3.6. Alternative dispute resolution for Consumers
After the internal complaint process has been completed, a Consumer may use an out-of-court dispute resolution procedure where one is available for the matter. Information and assistance may be obtained from a municipal or district consumer ombudsman, the Polish Trade Inspection, ADR entities listed by the Office of Competition and Consumer Protection, UOKiK, and, for a cross-border dispute within the EU, the European Consumer Centre.
Participation in a specific procedure depends on its rules and, where required, the parties’ consent. Access to alternative dispute resolution does not prevent either party from bringing a claim before the competent court.
4. LIABILITY, EXTERNAL SERVICES AND CONTENT
4.1. Liability
ONE PLUS is responsible for properly performing its own obligations under the agreement and applicable law. Nothing in these Terms excludes liability that cannot lawfully be limited or removes mandatory Consumer rights.
ONE PLUS does not guarantee a decision by a public authority, court, bank or other independent institution where the outcome is outside the company’s control. ONE PLUS is also not responsible for delay or an adverse result to the extent caused by inaccurate or incomplete Client information, late delivery of documents, a deadline missed by the Client, the act of a third party, failure of an external system or an event outside reasonable control.
For Users acting in the course of business, liability may be further addressed in the Individual Agreement within the limits permitted by Polish law. Those limitations do not apply to a Consumer where they would conflict with mandatory protections.
4.2. Events outside reasonable control
A party is not responsible for delay caused by an event it could not reasonably prevent if it promptly reports the obstacle and takes available steps to reduce its effects. Examples include a prolonged infrastructure failure, action by an authority, closure of an office, cyberattack, strike, emergency, war, natural disaster or serious communications outage.
Such an event does not remove an obligation to refund a Consumer where a refund is required by law, nor does it release obligations that can still reasonably be performed despite the obstacle.
4.3. External services and links
The Website may link to public administration portals, maps, social networks, video services, messaging tools, payment providers and partner websites. When following an external link, the User is subject to the terms and policies of that provider.
ONE PLUS checks links when they are published but does not control external websites and is not responsible for later changes to their content, availability or security. A link does not amount to an endorsement of every service offered by the external provider.
4.4. Intellectual property
Texts, structure, original graphics, photographs, videos, logos, signs and other Website materials are protected by Polish and European law to the extent that they qualify for such protection. Some materials may be used under a licence from the rights holder.
Users may view the Website and save materials for lawful personal use. Quotation and other uses expressly permitted by law remain available. Mass copying, publishing a substantial part of the materials, removing authorship information, creating a misleading copy of the Website or commercially exploiting the brand requires an appropriate legal basis or the rights holder’s consent.
5. PRIVACY, GOVERNING LAW AND GENERAL TERMS
5.1. Personal data, cookies and marketing
The processing of personal data, legal bases, retention periods, recipients, User rights and cookie controls are described in the separate Privacy Policy and the Website’s cookie settings centre. These Terms do not duplicate that information.
Sending a service enquiry does not automatically constitute consent to marketing. Marketing communications are sent only where there is an appropriate legal basis and include the possibility to opt out in the applicable manner.
5.2. Governing law and courts
These Terms and agreements with ONE PLUS are governed by Polish law unless the Individual Agreement or mandatory law provides otherwise.
The choice of Polish law does not deprive a Consumer of the protection of mandatory provisions of the country in which the Consumer habitually resides where that protection applies under the EU Rome I Regulation. The competent court is determined under Polish procedural law and applicable EU rules, including the special jurisdiction provisions for Consumer disputes.
In disputes between businesses, the parties may agree on the courts at the registered office of ONE PLUS where this is permitted by law. This does not apply to a Consumer in a manner that restricts mandatory procedural rights.
5.3. Changes to these Terms
ONE PLUS may update the Terms because of changes in law, Website features, payment methods, service structure, security requirements or contact details. The date of the current version appears at the top of this page.
A change does not operate retrospectively or reduce rights already acquired by a Consumer. A new version applies to an ongoing Individual Agreement only to the extent allowed by that agreement and the law, or after any required notice or agreement.
If one provision is found invalid, the remaining provisions continue to apply where the arrangement can reasonably operate without the invalid part. The mandatory rule of law or lawful interpretation closest to the provision’s purpose applies in its place.
5.4. Language and availability
The Website is available in several languages. The translations are intended to help Users understand the rules and services. A particular order is governed by the language and documents used by the parties when making the Individual Agreement.
These Terms are available free of charge and may be saved or printed. A User who needs the text in a more accessible format or notices a technical problem may contact [email protected].
5.5. Main legal instruments
These Terms take account in particular of the following legislation, as amended:
- the Polish Civil Code of 23 April 1964;
- the Polish Consumer Rights Act of 30 May 2014;
- the Polish Act on Providing Services by Electronic Means of 18 July 2002;
- the Polish Act on Out-of-Court Resolution of Consumer Disputes of 23 September 2016;
- the Polish Copyright and Related Rights Act of 4 February 1994;
- Regulation (EU) 2016/679, the GDPR, in matters relating to personal data;
- Regulation (EC) No 593/2008 on the law applicable to contractual obligations, Rome I;
- Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
This list explains the legal basis of the Terms but does not replace an assessment of a particular agreement or situation.
6. ELECTRONIC SYSTEMS, CRM AND COMMUNICATIONS
6.1. Supplement concerning electronic systems, CRM, SMS and payments
Supplement version: 28 September 2026.
These provisions supplement the Terms in relation to electronic case management, communication with Clients, SMS delivery and payment acceptance. They do not replace an Individual Agreement or information given for a particular service. If a feature is not available for a specific User or type of matter, describing it here does not oblige ONE PLUS to activate it.
ONE PLUS selects tools according to the nature of the case, required level of security, technical availability and the agreed way of working. The company may use its own systems and specialist providers, in particular ONE PLUS CRM, SMSAPI and SumUp. Each system performs a separate function and receives only the information needed for that function.
6.2. ONE PLUS CRM and electronic case management
ONE PLUS may use the environment available at crm.one-plus.pl to organise contact, manage cases, monitor deadlines, allocate tasks, record arrangements, exchange documents and report work progress. The system may operate as an internal workspace, a Client portal or a solution connected to forms, email, telephony, SMS and other service tools.
Depending on the service, the CRM may contain contact details, a case number or name, the scope of instructions, the team member responsible, missing-document lists, deadlines, a history of agreed actions, internal status, payment information, document copies and messages relating to performance of the agreement. The information visible to a particular person depends on that user’s role and permissions.
A status displayed in the CRM is operational information maintained by ONE PLUS. It is not an electronic document issued by a public authority, an administrative decision or a guarantee of an outcome or timeframe. If an authority, court, bank or other institution provides a separate official system, legally relevant information comes from the proper source and from documents served in accordance with law. ONE PLUS updates CRM records using information available to it, but an update may require prior receipt of a letter, confirmation or message from the Client or institution.
Access to a Client portal does not transfer rights to ONE PLUS software, source code, interface, databases or branding. The Client receives a limited, non-exclusive and revocable right to use the portal solely to manage their own matter. Users must not share access with unauthorised persons, extract data automatically, circumvent restrictions, test security without written permission or use the portal for an unlawful purpose.
6.3. CRM access and the User’s security responsibilities
If a Client receives an individual login, access link, one-time code or other authentication details, they must protect them from third parties. Passwords should not be sent in an ordinary message, stored in a publicly accessible place or reused across services. The Client should use an up-to-date device, protect their email account and telephone number and sign out after using a shared device.
A suspected account takeover, unknown login, incorrectly assigned document or disclosure to the wrong person must be reported immediately to [email protected] or [email protected]. To protect the Client, the system or another person, ONE PLUS may temporarily suspend access, invalidate a link, require credentials to be changed or ask for identity verification.
To the extent permitted by law, a Client is responsible for actions taken by a person to whom the Client deliberately gave access. This does not limit ONE PLUS’s responsibility for its own negligence or mandatory consumer rights. ONE PLUS will never ask through CRM or SMS for a full online-banking password, payment-card PIN or CVV/CVC.
6.4. Notifications and SMS messages sent through SMSAPI
ONE PLUS may send text messages through SMSAPI, a service provided by LINK Mobility Poland Sp. z o.o. Messages may include confirmation of contact or an appointment, a deadline reminder, notice that a document is ready, a request for missing material, an organisational change, the status of an agreed stage, an account-security notice, payment confirmation or another message directly related to an enquiry or agreement.
Only the information needed for technical delivery is sent: in particular the telephone number, message content, sender identifier, submission time and delivery or error data. Where possible, the wording is limited so that a person who sees the message cannot learn unnecessary details of the case. If the service involves sensitive information, ONE PLUS may instead send a neutral notice asking the recipient to contact the company or sign in through the appropriate secure channel.
Where SMSAPI processes data on documented instructions from ONE PLUS, the provider acts as a processor under Article 28 GDPR and the applicable data-processing agreement. In some contexts, SMSAPI may act as a separate controller where necessary for its own legal duties, network security, billing, complaints or telecommunications data. Current information is available in the provider’s Privacy Policy and on its infrastructure security page.
An operational message concerning an active matter or ordered service is not a newsletter. Marketing communications are sent only where the required legal basis exists, and the User may withdraw consent or object under the Privacy Policy. Opting out of marketing does not disable messages needed to perform an agreement, protect security or deal with an enquiry.
6.5. SMS delivery and keeping the telephone number up to date
Delivery also depends on the telecommunications operator, network coverage, the device, accuracy of the number, handset settings and external infrastructure. A “sent” status means that the message was passed on for delivery; a technical delivery status does not necessarily prove that the recipient personally read it. ONE PLUS does not guarantee immediate delivery of every SMS but, where it knows of a failure, takes reasonable steps to use another agreed channel.
The Client should provide the correct number, notify ONE PLUS when it changes and protect their SIM card and device. If a number is taken over, disconnected or transferred to another person, ONE PLUS should be informed immediately. Consequences caused solely by an outdated number or device-side blocking are assessed in light of the circumstances, the Individual Agreement and applicable law.
Unless the law or an Individual Agreement provides otherwise, an SMS is an auxiliary notice. It does not replace formal service of a decision, request, court document or statement requiring a particular form, and it does not remove a statutory duty to monitor a deadline. Failure to receive an SMS does not release the Client from responding to a document received through an official channel.
7. PAYMENTS AND SETTLEMENT
7.1. Payments processed by SumUp
ONE PLUS may accept payment using SumUp solutions, including a card terminal, contactless payment, payment link or another option made available for a particular order. Displaying a method does not mean it will be available for every service, amount, currency or Client. Available methods and the amount due are shown before the payment is submitted.
Technical and regulated payment processing is carried out by the relevant SumUp group entity under its terms, card-scheme requirements and payment-services legislation. SumUp may act as a separate controller for transaction data, fraud prevention, payment disputes, accounting, anti-money-laundering duties and other regulatory obligations. The current scope is described in the SumUp Privacy Policy and the legal information published by that provider.
For a SumUp payment, card details are entered into the provider’s device or interface. ONE PLUS generally does not receive or store the full card number, CVV/CVC or PIN. It may receive information needed to identify and reconcile the transaction, such as the amount, currency, date, identifier, status, method, limited payment-instrument reference and information supplied for a sales document.
SumUp may use authentication, risk controls, fraud detection, 3-D Secure or strong customer authentication where required by law or the nature of the transaction. A request for an additional step does not mean that ONE PLUS has obtained the Client’s online-banking credentials or made the authorisation decision itself.
7.2. Payment authorisation, confirmation and refusal
Attempting a payment is not the same as completing it. Payment is treated as accepted after ONE PLUS receives reliable confirmation of a successful transaction status from the operator or after the funds are credited, depending on the payment method and the parties’ arrangements. A temporary hold shown on the Client’s account may precede final settlement.
A bank, card scheme or SumUp may refuse or suspend a payment because of incorrect details, insufficient funds, a limit, additional authentication, suspected abuse, a regulatory restriction or a technical failure. ONE PLUS does not always receive the full reason for the operator’s decision. The Client may try again, choose another available method or contact their bank; they should not send full card details or login credentials to ONE PLUS.
A SumUp transaction confirmation does not replace an invoice or another sales document issued by ONE PLUS. The document is prepared from information supplied by the Client in accordance with tax rules. An error in invoice information should be reported as soon as it is noticed.
7.3. Refunds, payment complaints and chargebacks
A payment is refunded where required by law, an accepted complaint, effective withdrawal or an agreement between the parties. As a rule, SumUp sends the refund to the same instrument or payment method used for the transaction, unless the law, a technical limitation or an express arrangement permits another secure method. The time taken for funds to appear also depends on the payment operator, card scheme and the Client’s bank.
A complaint about a ONE PLUS service should be submitted to ONE PLUS under section 14 of these Terms. A technical problem with authorisation or a payment instrument may require contact with the bank or SumUp. ONE PLUS can help provide available transaction identifiers but cannot make an authorisation decision on behalf of a bank.
A chargeback is handled under bank and payment-scheme rules. Opening the procedure does not in itself establish that the service was performed incorrectly or that the Client’s claim is justified. To the extent permitted by law, ONE PLUS may provide the operator and bank with evidence of the transaction, agreement, communications and performance. This does not restrict a Consumer’s right to complain, withdraw from the agreement or use another legal remedy.
8. SECURITY, AVAILABILITY AND ELECTRONIC EVIDENCE
8.1. System security and infrastructure in Poland
Core operational data maintained directly in the ONE PLUS CRM environment is, under the current configuration, hosted on protected server infrastructure located in Poland. ONE PLUS applies risk-appropriate measures including HTTPS/TLS encryption, access controls, individual accounts, logging of significant events, updates, network protection, backups and incident-response procedures.
The Polish location of the core CRM environment does not mean that every technical transmission, SMS, payment, email service, auxiliary copy or third-party service is performed on one server and only in Poland. SMSAPI, SumUp, telecommunications operators, banks and other providers process the necessary information in their own infrastructure in accordance with their role, agreements and the law. Any transfer outside the EEA follows the Privacy Policy and uses an appropriate legal mechanism.
No system is absolutely immune to every threat. ONE PLUS periodically reviews safeguards, permissions, suppliers and backups and may carry out testing, vulnerability assessments or risk-appropriate audits. A particular certificate or completed audit is described as a fact only where a current document confirms its scope and outcome.
For security reasons, ONE PLUS does not publish configuration details, credentials, backup locations or mechanisms that could facilitate an attack. Users receive clear information about the rules, but may not demand disclosure of trade secrets or information that would weaken protection for others.
8.2. Confidentiality, data minimisation and no sale of personal data
ONE PLUS does not sell client databases, telephone numbers, documents, case histories or payment data. Information is used to respond to an enquiry, perform an agreement, protect security, comply with law, settle accounts, protect legal claims and for other purposes described in the Privacy Policy. Disclosure to a technical provider is not a sale; it is limited to the relevant function and supported by an appropriate legal basis.
Internal access is granted according to role and need. A person handling payment does not need access to the entire case file, and an SMS provider does not receive the full Client profile merely because it delivers a message. Where a purpose can be achieved with less information, ONE PLUS limits the content, permissions or retention period.
Documents may be disclosed to an authority, court, bank, professional representative, notary, translator or another participant only where this follows from the instructions, an authorisation, an agreement or the law. A person should provide ONE PLUS only with information they are entitled to disclose.
8.3. System availability, maintenance and business continuity
ONE PLUS takes reasonable steps to keep the website, CRM and communication functions available but does not guarantee uninterrupted operation 24 hours a day. Short periods of unavailability may result from updates, maintenance, backups, failure, attack, overload, operator problems or force majeure. Planned work is, where possible, carried out in a way that limits its impact on Clients.
A failure of CRM, SMSAPI or SumUp does not remove an obligation that can be performed through another available channel. If a function is unavailable, the Client may contact ONE PLUS by telephone or email. ONE PLUS may temporarily replace a provider or method with an equivalent solution, provided the Client’s statutory rights and an appropriate level of protection are maintained.
ONE PLUS is not responsible for an interruption solely on the side of an external provider to the extent that it could not reasonably prevent it, but remains responsible for its own obligations, appropriate supplier selection and action required after learning of the problem. Nothing excludes liability that cannot lawfully be limited in relation to a Consumer.
8.4. Logs, confirmations and evidence of electronic actions
For security, diagnostics, settlement, abuse prevention and evidence of the working relationship, systems may record the date and time of an action, delivery status, transaction identifier, request source, status change, user who performed an operation and other necessary metadata. A log does not always contain the full text of a document or message.
A system confirmation, CRM history, SMS delivery report, payment confirmation, email or action record may be used as evidence of service to the extent permitted by law. This does not waive the Client’s right to challenge an error, and all relevant circumstances must still be considered.
The retention period for logs and documents depends on purpose, legal duties, security, settlement and the protection of claims. Detailed criteria, individual rights and deletion rules are set out in the Privacy Policy.
8.5. Changing a technical provider or function
A provider or function may change because of technological development, security requirements, availability, law or commercial conditions. ONE PLUS may replace the CRM, SMS operator or payment operator with a solution providing a comparable function and appropriate protection. A change that materially affects Client rights, payment or data processing is communicated to the extent and in the form required by law.
A technical change does not automatically alter the price or scope of an Individual Agreement. If new consent, separate acceptance or an amendment is required, ONE PLUS will request the appropriate action before applying the change to that Client.
8.6. Relationship with the Privacy Policy and Individual Agreement
This supplement governs the use of functions and allocation of responsibility. Detailed information about the controller, legal bases, recipients, international transfers, retention, cookies, individual rights and incidents is provided in the Privacy Policy. The Terms and Privacy Policy should be read together, but each document has a different purpose.
If documents conflict, mandatory law and the Individual Agreement for the particular service take priority in the order described in section 8. An external provider’s terms apply to its own service, but do not deprive the Client of claims against ONE PLUS arising from the agreement or law.
9. ADDITIONAL CONTRACT RULES AND PROTECTION OF THE PARTIES
This section supplements the earlier provisions and explains practical rules for working with ONE PLUS. It does not restrict Consumer rights or any other protection that cannot be excluded under Polish or European Union law.
9.1. Pre-contract information and a durable medium
Before a Consumer is bound by a paid distance contract, ONE PLUS provides the information required by law in a clear manner, including the main characteristics of the service, company details, the total price or calculation method, known additional charges, payment and performance arrangements, the complaint procedure and information about the right of withdrawal. Confirmation may be supplied by email, through the CRM, in a PDF or on another durable medium that allows the content to be stored without alteration.
General website content may be updated. For a particular order, the information supplied when it was accepted and the documents identified in the order-of-priority clause apply. A client’s failure to save a copy does not remove rights granted by mandatory law.
9.2. Electronic statements and identity confirmation
Arrangements may be made by email, CRM, web form, electronic signature or another accepted channel where the content and the person taking the action can be established. For a higher-risk transaction, ONE PLUS may request additional confirmation of identity or authority.
ONE PLUS does not ask for an online banking password, BLIK code, login SMS code, Profil Zaufany password or complete credentials for a public authority system. A client should not disclose such information even to someone claiming to represent the company.
9.3. Changes to scope and additional work
If new facts, an authority’s request, an additional translation, a separate procedure or a specialist become necessary, ONE PLUS explains the effect on scope, price and the expected timeframe. Paid work beyond the agreed instruction requires the client’s acceptance, unless the action is free of charge or immediately necessary to prevent direct harm and the law permits action without prior confirmation.
Silence does not amount to automatic acceptance of a new paid service. Work may nevertheless be paused where it cannot safely continue without a decision or document from the client.
9.4. Public fees, third-party costs and exchange rates
ONE PLUS’s fee is separate from government, stamp, court and notarial charges and from translation, delivery, insurance, bank or other third-party costs unless the offer expressly says otherwise. The amount and due date of an external charge may be set by law or a third party’s tariff and may change independently of ONE PLUS.
Where a payment or cost is denominated in a foreign currency, final conversion depends on the bank, provider and processing time. ONE PLUS does not add a hidden fee but is not responsible for a rate or charge set solely by the client’s financial institution.
9.5. Client documents and third-party data
The client confirms that documents and data used in the matter may lawfully be provided. Where material relates to an employee, family member, company participant or another person, the client should limit it to what is necessary and fulfil any privacy information duty that applies to the client.
ONE PLUS may refuse material that was obtained unlawfully, is clearly forged, is unrelated to the matter or contains excessive data. Accepting a copy for review does not confirm its authenticity.
9.6. Official deadlines and urgent matters
Clients must promptly forward requests, decisions and correspondence containing a deadline. ONE PLUS confirms whether an urgent action can be taken after reviewing the document. Merely sending a message in the evening, on a non-working day or without complete material does not guarantee action before the deadline expires.
If a deadline falls before an instruction can realistically be accepted, ONE PLUS may decline the matter or limit assistance to lawful steps that remain possible. Payment alone does not replace express confirmation that an urgent instruction has been accepted.
9.7. Decisions of public authorities and no guarantee of outcome
ONE PLUS is responsible for its own agreed work, but it does not make administrative decisions and cannot guarantee an authority’s approval, a processing time, or the position of a court, bank or other independent body. Information about a typical timeframe or a previous outcome is illustrative and is not a promise of the same result.
The absence of a result guarantee does not release ONE PLUS from properly performing the contract and does not restrict the client’s statutory rights where the company fails to perform its own obligation or performs it improperly.
9.8. Review and approval before submission
Where the nature of the matter allows, the client may review data or a draft before it is signed or submitted. An error, omission or change of circumstances should be reported promptly. ONE PLUS corrects its own errors within the agreed service, while the consequences of approving inaccurate information supplied by the client are assessed in light of the cause and conduct of both parties.
9.9. Specialists, partners and subcontractors
Where professional authority or specialist knowledge is required, ONE PLUS may propose the involvement of an advocate, legal counsel, notary, tax adviser, sworn translator, accountant or another contractor. The client is told whether the specialist works for ONE PLUS or enters into a separate agreement and charges independently.
ONE PLUS is responsible for selection and coordination to the extent required by its own agreement. An independent specialist is responsible for work carried out under that specialist’s authority and contract. This does not exclude any ONE PLUS liability that cannot lawfully be limited.
9.10. Unlawful instructions and suspension of cooperation
ONE PLUS may refuse an action or suspend cooperation where an instruction is unlawful, is intended to mislead an authority, infringes another person’s rights, requires the use of a forged document or creates an unacceptable security risk. The company may request an explanation, an additional document or evidence of authority.
Refusing to carry out an unlawful instruction is not improper performance. Work properly completed before suspension is settled in accordance with the agreement and applicable law.
9.11. Automation and artificial intelligence tools
ONE PLUS may use automation or approved tools to organise correspondence, perform OCR, check completeness, create a working translation or prepare a draft. These tools are supportive; a document with legal significance should be checked by a person. An automated suggestion does not replace an authority’s decision or a specialist’s individual assessment.
Confidential information should not be entered into a publicly available AI service without an approved organisational basis and review of the provider’s terms. Personal data processing is governed by the Privacy Policy.
9.12. Secure communications and impersonation attempts
Clients should verify the sender’s domain, the bank account number and any payment instruction. ONE PLUS does not use an unsolicited messaging account to ask for a password, one-time code or installation of software giving remote access to a bank. A suspicious change of account, link or data request should be confirmed using the telephone number or address published on the Website.
9.13. Ending cooperation and handing over a matter
An agreement may be ended under the individual document and applicable law. On completion, ONE PLUS accounts for work performed, delivers the result and returns originals by the agreed method. Copies and evidence may be retained where required by law or to protect claims, in accordance with the Privacy Policy.
Ending cooperation does not automatically transfer the matter to a new provider. The client remains responsible for appointing a new representative and monitoring current deadlines unless the parties expressly agree assistance with the handover.
9.14. Mandatory rights and interpretation of the Terms
If a provision conflicts with mandatory law, that law applies and the remainder of the document continues to operate to the extent possible. Failure to exercise a right in one instance is not a waiver of that right in the future.
These Terms do not exclude liability, complaint rights, distance-contract withdrawal or access to a court where exclusion would be unlawful. Questions about a particular order may be sent to [email protected].
9.15. Insurance products and the roles of the parties involved
Where ONE PLUS helps a client select or enter into an insurance contract, including a policy offered in cooperation with Colonnade Insurance Société Anonyme Oddział w Polsce, the client is informed of the insurer’s identity and the roles of the parties involved in arranging the policy. ONE PLUS does not become the insurance undertaking and does not assume duties which the law or the contract assigns to the insurer.
The scope of cover, exclusions, insured amount, premium, commencement and expiry of liability and the claims procedure are governed by the policy, the general terms and conditions of insurance (OWU), the Insurance Product Information Document (IPID), the benefits table and any other documents supplied before the contract is made. A short explanation on the Website or in a message does not replace those documents.
9.16. Policy information, commencement of cover and use before an authority
The client must provide accurate and complete information needed to identify their demands and needs and prepare the policy, review the document before entering into the contract and report any error promptly. Cover starts in accordance with the policy and the insurer’s documents; submitting a form, booking an appointment or providing information does not in itself mean that insurance cover has begun.
A policy arranged for a visa, residence permit, studies or family reunification does not guarantee that a visa or permit will be granted or that a particular document will be accepted. The competent consulate, voivodeship office or other authority makes the final assessment in light of the legal basis, period and circumstances of the case. Any case-specific request from an authority should be provided before the policy is arranged.
9.17. Insurance complaints and client rights
A complaint about service delivered by ONE PLUS may be made under clause 3.5. A complaint concerning the insurance contract, refusal of a benefit, claims handling or conduct of the insurer should also be submitted directly to the insurer using the details and procedure stated in the policy or OWU. ONE PLUS may help identify the appropriate channel but does not replace the insurer when a decision on a benefit is made.
These Terms do not restrict rights arising under insurance distribution, consumer protection or civil law, or the right — where available under applicable law — to approach the Polish Financial Ombudsman, the competent supervisory authority or a court. The existence and period of any withdrawal right depend on the type of contract, the law and the documents supplied to the client.
