1. GENERAL PROVISIONS

This Privacy Policy applies to the online platform available at https://www.one-plus.pl/ (the “Website”), operated by ONE PLUS Sp. z o.o., with its registered office at ul. Marszałka Józefa Piłsudskiego 43/7, 50-032 Wrocław, Poland. The company is registered with the District Court for Wrocław-Fabryczna, 6th Commercial Division of the National Court Register under the number KRS: 0000739695. Share capital: PLN 5,000. Tax Identification Number (NIP): 8971857670; Statistical Number (REGON): 380898127 (hereinafter referred to as “ONE PLUS”). At ONE PLUS, we place a high priority on protecting your privacy and safeguarding your personal data. Under no circumstances do we sell or transfer your personal data to third parties without your prior consent, unless otherwise required by applicable EU data protection regulations, including Regulation (EU) 2016/679 (GDPR).

By using our services, you acknowledge and consent to the collection, storage, transmission, and processing of your personal data (hereinafter referred to as “Processing”).

“Personal Data” refers to any information that identifies, or can be used to identify, an individual, such as: full name, date of birth, residential address, or email address.

Some services may be provided by third-party entities. In such cases, by using these services, you acknowledge and agree to the privacy policies of those third parties. These providers may request your separate consent before delivering their services, in line with EU law.

This Privacy Policy is an integral part of and supplements the general Terms of Use of the ONE PLUS platform.

2. WHAT DATA DO WE PROCESS?

2.1 Website Access

When visiting the website, even without registration, the following data is automatically processed:

  • IP address;

  • Browser data;

  • Visited URLs;

  • Date and time of access.

When accessing the website from mobile devices, the following data may also be processed:

  • Device model and manufacturer;

  • Operating system (“iOS”, “Android”).

The above data may also be processed using third-party services, in particular Cloudflare, Inc., which provide protection of the website, contact forms, and user interactions against spam, automated requests, and other abuse (including the use of Cloudflare Turnstile).

Data is processed exclusively for the purpose of ensuring the proper operation and security of the website, preventing cyberattacks, fraud, and unauthorized access. Cloudflare processes data as a data processor in accordance with applicable data protection laws.

2.2 User Registration

To use the extended features of the platform, user registration is required. Registration may be completed using Facebook or Google accounts.

(a) Registration via Facebook or Google

When choosing to register through social networks, you will be redirected to the relevant third-party websites to enter your login credentials. The platform may receive the following data:

  • First and last name;

  • Profile picture;

  • Email address.

Any additional data is imported only with your explicit consent. You may disconnect your social media account from the platform at any time in the “My Settings” section.

(b) Registration without social networks

If registration is completed without using social networks, the following data must be provided:

  • Username (nickname);

  • Email address;

  • Password;

  • Confirmation of legal age.

Your username (nickname) will be visible to other users of the platform. All other personal data remains hidden and is not publicly accessible.

3. PURPOSES OF DATA PROCESSING

Your data is processed for the following purposes:

  • Providing platform services;

  • Identification and security;

  • Offering vacancies and services that may be of interest to you;

  • Improving the platform and its functionality;

  • Compliance with EU and Polish law;

  • Prevention of cyber threats, spam, and fraud, including through the use of Cloudflare services.

4. INTERNET SECURITY

Your account is protected by a password. Never share it with third parties and always log out when using public devices.

We implement technical and organizational security measures, including the use of modern web infrastructure and traffic protection solutions (including Cloudflare). However, 100% security of data transmission over the Internet cannot be guaranteed.

5. DATA SHARING WITH THIRD PARTIES

ONE PLUS collaborates exclusively with trusted service providers who meet high standards of data protection. These include IT maintenance, data analytics, payment processors, and customer support.

Some partners may be located outside the European Economic Area (EEA). In such cases, we ensure that data transfers comply with EU regulations through appropriate legal safeguards. For further details, please contact: biuro@one-plus.pl.

6. DISCLOSURE TO PUBLIC AUTHORITIES

We are legally obliged to disclose personal data to public authorities, regulatory bodies, or law enforcement agencies in cases where it is required by law to prevent or investigate criminal activity.

7. USE OF COOKIES

With your consent, we use cookies to analyze site traffic, personalize content, and enhance advertising effectiveness. You can learn more about cookies at: www.aboutcookies.org or www.allaboutcookies.org.

8. GOOGLE SERVICES: ANALYTICS, ADSENSE, REMARKETING

The platform uses services provided by Google, including Google Analytics, AdSense, and Remarketing, to monitor user behavior and deliver relevant ads.

9. THIRD-PARTY COOKIES

This Privacy Policy is reviewed and updated regularly to ensure ongoing compliance with applicable EU and Polish regulations.

11. INTELLECTUAL PROPERTY RIGHTS ON WEBSITE CONTENT

11.1 Images obtained from free Canva stock sources

Images on the Website obtained from free stock sources via the Canva application are used in accordance with the Canva license. These images are protected by watermarks of ONE PLUS Sp. z o.o. and may not be used, copied, distributed, modified, or applied for commercial or non-commercial purposes by other organizations, individuals, or third parties without written permission from ONE PLUS. Any violation is prohibited under Polish copyright law, including the prohibition of removing watermarks (Article 17 of the Act), and may result in legal action for infringement of economic and moral rights.

11.2 Images created by ONE PLUS

Images created or modified by ONE PLUS Sp. z o.o., including those with watermarks in the form of a logo, as well as those without watermarks but possessing characteristics of intellectual property (e.g., original designs, graphics, or photos), are the exclusive property of ONE PLUS. Their use, copying, distribution, or modification without explicit written permission is prohibited. According to Article 16 of the Copyright Act, ONE PLUS holds full economic rights, including the right to reproduce, distribute, and publicly display. Violations are subject to enforcement, including removal of illegal copies and compensation for moral damages.

11.3 Copying text from the Website

Copying, reproducing, distributing, or using texts from the Website, including articles, blog posts, service pages, descriptions, and any other textual content, is prohibited without prior written permission from ONE PLUS Sp. z o.o. This includes both complete and partial copying. Under Article 23 of the Copyright Act, personal use without distribution is allowed, but any commercial or public use is subject to liability. Violations may result in website access being blocked and legal claims for copyright infringement.

11.4 Prohibition on using trademarks and logos

Trademarks, logos, and trade names of ONE PLUS Sp. z o.o., registered with the Patent Office of the Republic of Poland (Urząd Patentowy RP) under the Industrial Property Law of June 30, 2000 (Ustawa Prawo własności przemysłowej), may not be used without written permission. This includes their placement on other websites, in advertising, or on products. Violations may result in fines up to PLN 1,000,000 and a prohibition on use (Articles 296–308 of the Industrial Property Law).

11.5 Protection of website design and structure

The design, layout, graphical elements, and structure of the Website are protected as industrial designs and copyrighted works under the Copyright Act and Industrial Property Law. Copying or imitating the design is prohibited. The protection period for industrial designs lasts up to 25 years from the date of registration (Article 102 of the Industrial Property Law). Violations are subject to legal enforcement, including cessation of use and compensation for damages.

11.6 Prohibition of automated data extraction (scraping)

Automated extraction, scanning, or collection of data from the Website (web scraping, crawling) without written permission from ONE PLUS is prohibited. This infringes database rights under Article 7 of the Copyright Act and EU Directive 96/9/EC on the legal protection of databases. Such actions may result in technical blocking of IP addresses, as well as claims for unauthorized access and damages.

11.7 Creation of derivative works

The creation of derivative works based on Website content (e.g., modification of images, adaptation of texts, or redesign) is prohibited without permission. According to Article 2 of the Copyright Act, derivative works require the consent of the original rights holder. Violations result in liability for infringement of moral rights (attribution and integrity) and economic rights.

11.8 Liability for violations

In the event of infringement of ONE PLUS intellectual property rights, ONE PLUS reserves the right to:

(a) demand immediate cessation of the violation;

(b) claim compensation for damages, including lost profits;

(c) require publication of apologies;

(d) take legal action to protect its rights.

All disputes are resolved in the courts of the Republic of Poland at the company’s registered office (Wrocław). Applicable law — Polish and EU law. ONE PLUS may also report violations to competent authorities, including the police and prosecution, for criminal prosecution.

11.9 Additional protective measures

ONE PLUS employs technical measures, such as watermarks, meta tags, and monitoring, to protect content. Users agree not to circumvent these measures. The policy may be updated to strengthen protection in accordance with changes in Polish law, including recent amendments to the Copyright Act of 2025, facilitating digital contract enforcement.

12. DOCPHOTO ONLINE AND DOCPHOTO PREMIUM TOOLS — SPECIAL TERMS OF USE

12.1. Nature of the Tools

DocPhoto Online and DocPhoto Premium (hereinafter jointly referred to as the “Tool”) are free auxiliary digital tools designed exclusively for the technical processing of photographs in order to prepare them for submission via the MOS 2.0 system (Moduł Obsługi Spraw). The Tool is not an official service of the public authorities of the Republic of Poland, is not organisationally or legally affiliated with them, and does not represent their position.

12.2. Information Provided to Users

ONE PLUS Sp. z o.o. has taken all reasonable measures to provide users with comprehensive, up-to-date and clear information regarding the photo requirements for a residence card (karta pobytu), namely:

  • technical file parameters: JPG format, minimum resolution of 684×883 pixels, maximum file size of 2.5 MB;
  • composition requirements: face from the top of the head to the upper part of the shoulders, occupying 70–80% of the frame;
  • background requirements: plain light background, free of shadows, patterns and foreign objects;
  • pose and expression requirements: neutral gaze directed straight at the camera, open eyes not covered by hair, closed mouth, head held straight, natural skin tone;
  • permitted exceptions: dark-tinted glasses with supporting medical documentation; head covering for religious reasons provided the face is fully visible;
  • validity period: the photograph must have been taken no earlier than 6 months before the date of submission;
  • illustrative examples of correct and incorrect photographs, displayed directly within the Tool interface;
  • an algorithm for automatic face detection and recommended frame alignment (DocPhoto Premium).

The fact that the above information has been provided is recorded within this Policy. By continuing to use the Tool, the user confirms that they have read and understood the aforementioned requirements.

12.3. Automated Processing — Advisory Nature

The face detection, cropping and compliance verification algorithms used in DocPhoto Premium are purely advisory in nature. The result of automated processing does not constitute a legally binding assessment of a photograph’s suitability. The user is solely responsible for visually verifying the final image before using it.

12.4. Changes to Public Authority Requirements

ONE PLUS Sp. z o.o. accepts no liability for changes to the requirements of the Voivodeship Office (Urząd Wojewódzki), the MOS 2.0 system or other public authorities that occur after the most recent update of the Tool. The user is solely responsible for verifying the current requirements on the official resources of the relevant authorities.

13. FULL DISCLAIMER OF LIABILITY

13.1. User and Applicant Responsibility

Responsibility for the quality, compliance and suitability of a photograph for submission of an application rests exclusively with the user and the applicant. Use of the Tool does not relieve the user of the obligation to independently verify that the photograph meets the current official requirements.

13.2. Exclusion of ONE PLUS Liability

ONE PLUS Sp. z o.o. accepts no liability whatsoever, including but not limited to:

(a) Refusal by public authorities: refusal to accept, return or rejection of an application by public authorities due to the photograph failing to meet the prescribed requirements — regardless of whether the photograph was processed using the Tool;

(b) Outcome of case proceedings: any outcome of the processing of an application for a residence permit, residence card (karta pobytu) or other permits, including refusals, delays, suspension or termination of proceedings;

(c) Financial and time losses: costs incurred by the user in connection with resubmitting an application, paying government fees, obtaining new photographs, paying for legal assistance or any other expenses;

(d) User errors: errors made during manual cropping, selection of the image area, manual adjustment of the automated processing result, or when using other Tool parameters;

(e) Post-processing: any modifications made by the user to the photograph after it has been processed by the Tool;

(f) Technical failures: temporary unavailability of the Tool, browser errors, connection interruptions or other technical issues arising on the user’s side or on their device;

(g) Unmet expectations: the user’s subjective dissatisfaction with the result of processing or the result not matching the user’s personal expectations.

13.3. Limitation of Aggregate Liability

To the maximum extent permitted by applicable law, the aggregate liability of ONE PLUS Sp. z o.o. to the user on any grounds related to the use of the Tool shall not exceed PLN 0 (zero Polish zlotys), as the Tool is provided free of charge.

13.4. Force Majeure and Legislative Changes

ONE PLUS Sp. z o.o. accepts no liability for the inability to use the Tool or for inaccuracies in the information provided, caused by force majeure events, including: changes in Polish and EU legislation, decisions of public authorities, technical changes to the MOS 2.0 system, and other events beyond the company’s reasonable control.

14. PRIVACY AND DATA PROTECTION IN DOCPHOTO TOOLS

14.1. In-Browser Image Processing

All photograph processing operations in DocPhoto Online and DocPhoto Premium are performed exclusively in the user’s browser on their device. Uploaded photographs and images:

  • are not transmitted to the servers of ONE PLUS Sp. z o.o. or to any third-party servers;
  • are not stored in the company’s databases;
  • are not processed by the company’s software outside of the browser;
  • are automatically deleted from the browser’s working memory when the tab or page is closed.

14.2. No Collection of Personal Data

In connection with use of the Tool, ONE PLUS Sp. z o.o. does not collect, store or process users’ personal data, including biometric facial data obtained by the face detection algorithm. The algorithm operates locally within the browser and does not transmit the results of image analysis beyond the user’s device.

14.3. Anonymous Usage Counter

The Tool maintains an anonymous counter of the number of photographs processed. This counter:

  • contains no link to the identity of the user;
  • does not store images or image metadata;
  • does not allow any individual user to be identified.

14.4. Machine Learning Models

DocPhoto Premium uses machine learning models for face detection (TinyFaceDetector, FaceLandmark68TinyNet), loaded from public CDN repositories. These models:

  • execute exclusively within the user’s browser;
  • do not transmit analysis results to external servers;
  • do not store or accumulate biometric data.

14.5. GDPR/RODO Compliance

Since personal data of users is not collected or processed by ONE PLUS Sp. z o.o. in connection with use of the Tool, Regulation (EU) 2016/679 (GDPR/RODO) applies to the Tool to the extent that it does not require the processing of personal data by the data controller. The company takes all reasonable technical and organisational measures to comply with the principles of Privacy by Design and Privacy by Default.

15. ACCEPTANCE OF TERMS AND FINAL PROVISIONS

15.1. Acceptance of Terms

Commencing use of the DocPhoto Online and DocPhoto Premium Tools constitutes the user’s full and unconditional acceptance of all terms of this Policy, including Sections 12–15, as well as the general Terms of Use of the ONE PLUS platform.

15.2. User Legal Capacity

The user warrants that they are a legally capable individual who has reached the age required to independently perform legally significant actions in accordance with the laws of their country of residence. Use of the Tool by minors is permitted only with the consent of a parent or legal guardian.

15.3. Currency of Terms

ONE PLUS Sp. z o.o. reserves the right to amend these terms unilaterally at any time for the purposes of:

  • ensuring compliance with changes in EU and Polish legislation;
  • reflecting updates to the requirements of the MOS 2.0 system;
  • correcting inaccuracies or supplementing the Policy.

The current version of the Policy is always available at one-plus.pl. Continued use of the Tool following publication of any amendments constitutes automatic acceptance of those amendments.

15.4. Severability

If any provision of this Policy is found to be invalid or unenforceable by a court or other competent authority, the remaining provisions of the Policy shall remain in full force and effect to the maximum extent permitted by applicable law.

15.5. Governing Law and Jurisdiction

This Policy is governed by the laws of the Republic of Poland. All disputes arising in connection with use of the Tool shall be subject to the exclusive jurisdiction of the competent courts at the registered office of ONE PLUS Sp. z o.o. — the city of Wrocław, Poland. The applicable law is that of Poland and the European Union, including, without limitation: the Polish Civil Code, the Copyright Act, and the GDPR/RODO Regulation.
