Civil marriage and residence status
A civil marriage in Poland is a civil procedure run by the Registry Office (USC). Marriage does not automatically grant residence or citizenship but may be a basis for a residence card for a foreign spouse after marrying a Polish citizen or another resident. That requires a separate voivode procedure after the wedding.
ONE PLUS has operated officially since 2018. For more than 12 years we have supported foreigners and Polish families in Wrocław at Piłsudskiego 43. The information below is general guidance. The registry office decides on marriage after document verification. We do not promise a wedding date or recognition abroad.
Who may marry in Poland
Polish citizen and foreigner
The most common scenario: a Polish citizen and a foreigner file for civil marriage at the USC competent for residence or planned ceremony location. Both must meet age, legal capacity and no legal impediments (e.g. prior marriage).
Two foreigners
Foreigners legally staying in Poland may also marry civilly at USC if formal requirements are met. Identity and stay documents must be current.
Civil vs religious marriage
Civil marriage at USC is separate from religious ceremony. A church or other denomination may require its own documents and prior civil marriage or concordat recognition, depending on rules.
Documents for USC
Identity and status of both parties
Passport or ID, proof of legal stay in Poland (for the foreigner), registration. USC verifies identity and absence of impediments.
Before the wedding, tidy up your PESEL number and residence registration if office data is outdated.
Civil status documents
A Polish citizen submits a birth certificate. A foreigner submits civil status documents from the country of origin (birth certificate, certificate of legal capacity to marry). Foreign-language papers need sworn translation. Some countries require apostille or consular legalisation.
Timeline and fees
After a complete application USC sets the marriage date (usually after a waiting period). USC fees follow regulations. ONE PLUS does not promise a specific ceremony date.
Procedure at Wrocław USC
Filing the application
Both fiancés file the marriage application in person at USC. The application includes both parties' data and planned ceremony place and date. USC verifies documents and may call for supplements.
USC information is published on Biznes.gov.pl and municipal websites. Wrocław has several USC offices serving the city.
Waiting period
After filing a waiting period applies before the ceremony (usually about one month, with possible shortening in justified cases). USC sets date and time.
Ceremony and marriage certificate
The ceremony takes place at USC with both parties and witnesses present. After the ceremony USC issues a short-form marriage certificate. The certificate supports further steps: name change, joint registration, residence card application.
Marriage and legalisation of stay
Residence card on marriage grounds
After marrying a Polish citizen a foreigner may apply for a residence card on marriage grounds. That requires a separate voivode procedure, marriage proof and joint residence. Marriage alone does not automatically grant a card.
Stay information is published by the Office for Foreigners (UDSC). After the wedding consider citizenship planning in the longer term.
Joint residence and registration
The voivode verifies actual joint residence. Joint registration strengthens a residence card application. No shared address weakens the case.
How ONE PLUS supports marriage in Poland
We are not USC or the voivode. Our role is preparation:
- review both parties' documents before USC visit;
- translation, apostille and legalisation checklist;
- assess impact on residence status;
- coordinate with other client matters, e.g. PESEL or a WSA court complaint in another file;
- USC and voivode visit logistics in Wrocław.
Wrocław USC offices handle Lower Silesia ceremonies. Early preparation reduces calls and delays.
Common mistakes before USC wedding
Incomplete civil status documents
Missing capacity certificate, invalid translation or missing apostille blocks the application. Check country-of-origin requirements before travel to Poland.
Inconsistent passport and registration data
Different name spellings or birth dates in documents trigger USC calls. Harmonise data before filing.
Confusing civil marriage with stay basis
Marriage gives grounds for a residence card application but does not replace legal stay before the wedding. A foreigner without a valid card or visa must legalise stay first.
