Apartment sale requires a notarial deed and a precise POA
Selling property in Poland is a notarial act with land register entry, encumbrance review and often tax consequences. When the owner lives abroad, has limited mobility or cannot reach Wrocław on the notary’s timeline, a sale POA becomes relevant. The document must identify the property, land register number and agent powers. A broad general POA for “property matters” rarely satisfies the notary handling the transaction.

What a property sale POA covers
Sale mandate vs preparatory acts
A property sale POA may authorize the agent to conclude a sale agreement for a specific apartment, house or share if the wording allows. It may also cover preparatory acts only: collecting land register excerpts, reviewing draft contracts or filing applications where the notary accepts that scope.
The difference matters in practice. Signing a sale agreement transfers ownership and creates responsibility. The agent must not exceed scope, or the act may be invalid or require repetition.
Notarial form
A POA for an act requiring notarial form must itself be notarial. Property sale belongs to that category, so a POA to sign the sale agreement requires notarial form. This is not a simple handwritten signature.
If the principal is abroad, the POA may be created at a Polish consulate or local notary with later legalization, depending on country rules and the Polish notary handling the sale.
When a property POA makes sense
Owner lives abroad
The most common scenario: the Wrocław apartment owner cannot travel for the notarial act. An agent in Poland may represent the owner if the POA allows and the notary accepts it.
Limited mobility or illness
When the owner cannot appear on schedule, a POA may enable completion of the transaction. Property markets are sensitive to timing, so prepare documents early.
Sale after inheritance or gift
Property from an estate or gift needs a clear title first. A sale POA is often a later step after inheritance or gift deeds, not the first document in the chain.
Linking PESEL and registration
Property sale is rarely the only document. You may also need a PESEL number, residence registration (zameldowanie) or tax office alignment before capital gains reporting. Plan those steps in order.
PESEL, land register and documents
PESEL number
Polish notaries and property systems expect PESEL where the person can obtain it. A foreign owner without PESEL is often asked to apply first because identification in transactions and tax filings becomes easier.
If the party is still settling in Poland, consider PESEL registration before scheduling the notary.
Land register and legal status
Before sale you must know exactly what is sold: address, register number, share, encumbrances, mortgages, easements. The POA should match the description used in the sale agreement. Mismatch leads to refusal or corrections.
Spouse consent and co-owners
Shared marital property or co-ownership may require spouse or co-owner statements. A POA does not replace required consent if law demands personal appearance.
Property POA vs other mandate types
A property sale POA does not replace a bank POA for the account receiving sale proceeds, a vehicle POA or child travel consent. Each act has its own form and content rules.
A general civil POA may help with mail collection but does not replace a notarial POA to sell a specific property.
Taxes and fees to remember
Property sale may trigger capital gains tax or exemption depending on circumstances, holding period and use of proceeds. A POA does not replace the seller’s tax duties. The agent acts within granted powers.
If the property came through gift or inheritance, acquisition history affects later reporting. Check podatki.gov.pl or consult a tax advisor for detail.

Wrocław has many notaries. Choice belongs to the parties, but a prepared question list and document pack reduces visits and formal refusals.
POA created abroad
When the principal lives outside Poland, the POA may be created at a Polish consulate or local notary abroad. The Polish notary handling the sale will assess form and legalization.
This is rarely a one-day process. Translation, apostille or superlegalization may be required depending on the country of origin. A wrong document delays the sale by weeks.
Common mistakes before the notary visit
Wording that is too general
The notary may refuse if the POA does not identify the property. Prepare land register number and unit description early.
Missing spouse consent when required
Shared property rules may block the deed without required consent. A POA does not replace a spouse statement.
Inconsistent personal data
Different name spellings or addresses across passport, registration and land register cause classic delays. Align data in the office first.
Ignoring encumbrances
Mortgage, claims, easements or active lease affect sale content. The POA must reflect or clearly limit scope.
Relying on verbal price agreements
Oral price or deadline statements do not replace the notarial deed or POA. Formalization protects both sides but takes time.
