Car sale means a specific VIN, not a general POA
Transferring vehicle ownership or completing registration in Poland requires precise vehicle description, owner documents and clear agent powers. A car sale POA must identify the vehicle by VIN, registration number or other data accepted by the notary and traffic office. Broad wording such as “car matters” rarely supports signing a sale agreement or filing a registration application.
ONE PLUS has operated officially since 2018. For more than 12 years we have worked with foreigners and Polish families on administrative, tax and document matters. Our office is in Wrocław at Piłsudskiego 43. We know notary and traffic office practice, but every vehicle POA needs individual review.
The information below is general guidance. Scope, form and cost depend on vehicle type, owner status and whether the agent may only file an application or also sign the sale agreement. We do not promise a notary date or registration outcome. The notary or starosta decides admissibility.
What a vehicle POA covers
Sale mandate vs registration mandate
A sale POA may authorize the agent to conclude a sale agreement for a specific vehicle if the wording allows and the notary accepts it. A registration POA may cover filing at the traffic department, collecting plates or other admin steps linked to the vehicle.
In practice, separate those goals or describe them precisely in one deed if the notary and office accept the wording.
Notarial form
Sale acts requiring notarial form, or POAs for such acts, usually must be notarial. Some registration steps work with a written POA plus certified signature, but the traffic department may apply its own rules.
General POA vs vehicle POA
A general property POA does not replace a POA naming a specific vehicle. The notary expects VIN, make, model and registration data.
When a vehicle POA makes sense
Owner lives abroad
The most common scenario: the owner cannot travel to Poland for the sale or traffic office visit. An agent in Poland represents the owner within granted powers.
Limited mobility
When the owner cannot appear on schedule, a POA may enable sale or registration. Deadlines can be tight when a buyer waits for formalities.
Sale after inheritance or gift
A vehicle from an estate or gift requires a clear title first. A car sale POA is often a later step after inheritance or gift documents, not the first paper in the chain.
Linking PESEL and registration
A foreign owner often needs a PESEL number or residence registration (zameldowanie) before notary or starosta steps. Plan those steps in order.
PESEL, registration certificate and vehicle documents
Owner PESEL
Traffic departments and notaries expect PESEL where the owner can obtain it. A foreign owner without PESEL is often asked to apply first.
If the owner is still settling residence, consider PESEL registration before drafting the POA.
Registration certificate and vehicle card
Current registration certificate, vehicle card, liability insurance and VIN data. The POA should match data used in the sale agreement. Mismatch leads to refusal or corrections.
Agent and buyer documents
The agent must present identity documents. The buyer also appears at sale. Foreign-language papers often need sworn translation.
Vehicle POA vs other mandate types
A car sale POA does not replace a property sale POA, bank POA or child travel consent. If the owner also needs account access for sale proceeds, a separate bank POA may be required.
For company vehicles, check who may dispose of the asset under CEIDG or KRS records.
How ONE PLUS supports vehicle POA cases
We are not a notary and do not replace the notary at the deed. Our role is preparation:
- short review of owner status and POA purpose;
- checklist for vehicle, owner and agent documents;
- check whether PESEL, registration or translations are needed first;
- help with notary and starosta logistics in Wrocław;
- explain sale vs registration mandates;
- coordinate with inheritance or residence matters where relevant.
Wrocław has notaries and traffic offices handling Lower Silesia cases. Choice belongs to the parties, but preparation reduces visits.
POA created abroad
When the owner lives outside Poland, the POA may be created at a Polish consulate or local notary abroad. The Polish notary or starosta will assess form and legalization.
This is rarely a one-day process. Translation, apostille or superlegalization may be required.
Common mistakes before car sale
Missing VIN in the POA
The notary may refuse if the vehicle is not clearly identified. Prepare registration data early.
Scope that is too general
“Car matters” without sale or registration detail often fails.
Inconsistent owner data
Different name spellings across passport, registration and vehicle documents cause classic delays. Align data in the office first.
Unresolved encumbrances
Leasing, lien, car loan or blocking fines affect sale options. A POA does not remove those barriers.
Assuming dealer rules match private sale
Dealers and private sellers follow different paths. Confirm requirements before signing abroad.
