How a Belarusian can arrange a power of attorney in Poland

How a Belarusian can arrange a power of attorney in Poland for Belarus
ONE PLUS helps Belarusian citizens prepare a power of attorney in Poland for use in Belarus. We clarify whether a specific bank, notary or state body will accept the document, draft a suitable text, organise signing before a Polish notary, and — when needed — arrange translation, confirmation of the notarial act and apostille.
This guide focuses on practical power of attorney for Belarusians in Poland: what you can do without leaving the country, which data you need, when apostille is required, and where foreign documents often fail for banks, inheritance, cars or real estate in Belarus.
A power of attorney issued abroad must do more than carry a signature and a stamp. It has to fit the exact action in Belarus. A bank document, an inheritance file, a certificate request or representation before an authority will look different from a power of attorney linked to a car, an apartment or a land plot.
So the right starting point is not a random internet template. Start with one clear question: what must the representative do in your name, and which Belarusian institution will receive the document?
Tatiana Vyborna, a ONE PLUS specialist supporting foreigners with documents and notarial matters in Poland since 2015, stresses the same sequence in every case: first confirm that the Polish document will be accepted for the planned action, then draft the powers, and only afterwards book the notary. This protects clients from paying for a text that Belarus will refuse.
Can a Belarusian arrange a power of attorney without leaving Poland?
In many situations you can arrange the power of attorney directly in Poland. The most practical route is to prepare the document and sign it before a Polish notary in Wrocław or another Polish city.
Earlier, Belarusian citizens could also ask Belarusian diplomatic missions abroad to authenticate powers of attorney. Since 7 September 2023, however, Belarusian foreign missions are no longer authorised to authenticate powers of attorney. They still perform some other notarial acts — for example authenticating certain consents and refusals, certifying the authenticity of a signature, and certifying copies of documents.
That is why a Belarusian who lives in Wrocław, Warsaw, Kraków or another Polish city usually needs a Polish notary for a power of attorney today.
There is an important limit: not every action in Belarus can be completed under a power of attorney issued abroad. Before you prepare the text, check the requirements of the specific Belarusian institution that will receive it.
If the receiving side confirms that a Polish notarial power of attorney is acceptable, you can usually complete the whole process in Poland: drafting, signing, translation and, if required, court confirmation and apostille. You do not have to travel to Belarus only to put a signature on the document.
How to arrange a power of attorney in Poland for Belarus
The process usually starts with the purpose of the document. It is not enough to write that the representative may “act in all institutions”. A Belarusian bank, notary, registration authority or another organisation may require very specific powers.
For example, the text may need to list separately the right to file applications, sign documents, collect certificates, dispose of a bank account, represent you in an inheritance case, collect correspondence or pay state fees.
After the scope of powers is agreed, the text is prepared. The document can be drafted in Polish, in a bilingual form, or with a later translation into Russian or Belarusian. The best option depends on the notary and on the institution that will use the power of attorney.
Then the principal appears in person before a Polish notary with a valid identity document. The notary verifies identity and performs the required notarial act.
After signing, you may need a sworn translation of the notarial clause and other Polish marks. In some situations an apostille is also arranged — but for documents between Poland and Belarus this question needs a separate check, not an automatic assumption.
ONE PLUS coordinates the steps so the client does not have to guess the order: check acceptance → prepare powers → sign at the notary → translate → confirm and apostille only if the receiving side truly needs it. If you already have a draft from a Belarusian notary or bank, send it before the visit so we can align the Polish text with those requirements.
Do you need an apostille on a power of attorney for Belarus?
Poland and Belarus have a bilateral legal assistance treaty. Under Article 11 of that treaty, documents drawn up or authenticated by a competent authority of one country, bearing an official seal and the signature of an authorised person, have evidentiary force in the other country without legalisation. The same rule also covers officially authenticated copies and translations.
Therefore you should not automatically claim that every Polish power of attorney for Belarus needs an apostille. In many cases a correctly prepared Polish notarial document should be accepted without extra legalisation.
In practice, before signing it is still wise to obtain confirmation from the specific Belarusian bank, notary or state body. The institution may set its own rules for form, language, translation, the wording of powers and the validity period.
If the receiving side still asks for an apostille, or the document will also be used in another country, the procedure usually has two stages. First the signature and seal of the Polish notary are confirmed by the competent district court. Then an apostille can be obtained at the Polish Ministry of Foreign Affairs. The official fee for an apostille is 60 PLN per document. Official information about the Polish apostille procedure on gov.pl helps clients understand the state fee and the general route.
ONE PLUS first checks whether apostille is really necessary, so the client does not spend time and money on an unnecessary step. When apostille is needed, we also help with related apostille services and the order of court confirmation.
Useful official portals for orientation include the MFA apostille page and the Ministry of Justice portal. Final acceptance still depends on the Belarusian institution that will use your document.
What data is needed to prepare a power of attorney
To prepare the power of attorney you need a valid passport or another identity document accepted by the notary for the principal.
You also need precise data of the representative in Belarus. This usually includes first name, surname and patronymic, date of birth, address, identification number and passport details. The full list depends on the purpose of the document and on the institution where the representative will appear.
If the power of attorney concerns property, you need documents or details that identify the object exactly. For an apartment this may be the address, registration number, area and owner data. For a car — make, model, registration plate, VIN and details from the registration certificate.
For bank documents it is useful to ask in advance for the official bank name, account numbers and the list of operations the representative must be allowed to perform.
If the matter concerns inheritance, ask the Belarusian notary who handles the case for an exact list of powers or a draft power of attorney. That approach sharply reduces the risk that a document already signed in Poland will have to be redone.
Bring scans or clear photos of passports and property documents early. Incomplete names, missing patronymics or outdated registration details are among the most common reasons why a Belarusian institution later rejects an otherwise correctly notarised paper.
Why a ready-made internet template may not work
The main problem with standard templates is that they ignore both the concrete task and the requirements of the receiving institution.
In one bank it may be enough to receive statements and extracts. Another bank may demand a separate right to open and close accounts, withdraw money, issue bank cards and sign applications.
In an inheritance case the notary may need powers to file an application, obtain certificates, request documents, pay expenses and register inherited property.
In property matters every word matters. The phrase “manage the apartment” does not always give the right to sell it, gift it, rent it out or register changes.
A well-prepared power of attorney is therefore not the longest possible text. It is a text that lists the necessary powers precisely and avoids unnecessary risks.
Internet templates also often mix legal systems. A form written for use inside Belarus, or a Polish form written for Polish courts only, may look “official” and still fail when a Belarusian bank or registry checks the wording. ONE PLUS prepares the document for the receiving side, not for a generic download page.
Which powers of attorney Belarusians most often arrange in Poland
General power of attorney
A power of attorney in Poland with a broad scope is often called a general power of attorney when the representative needs many related powers — for example to appear before institutions, sign applications, collect documents, deal with banks or handle several administrative matters at once.
The everyday label “general power of attorney” does not mean that the representative automatically receives the right to do absolutely everything.
Even in a broad document the powers must be stated clearly. Special care is needed for disposal of money and property, substitution (sub-delegation), receipt of funds and signing of contracts.
In some cases it is safer to prepare several separate documents for concrete tasks instead of one extremely wide power of attorney.
Power of attorney for a bank
A bank power of attorney must match the rules of the specific credit institution. There is no universal text that fits every bank in Belarus equally well.
The document may need to state expressly the right to open or close accounts, receive statements, dispose of funds, file applications, collect bank cards, change client data or sign documents.
Before arranging the document, contact the bank and ask for the list of required powers. Some banks use their own wording or still require the client’s personal presence for certain operations.
ONE PLUS prepares the document on the basis of the bank’s answer, not on the basis of a generic template.
Power of attorney for inheritance
An inheritance power of attorney may be needed when the succession case is open in Belarus and the heir is in Poland and cannot take part in person.
The representative may be authorised to communicate with the notary, file applications, collect documents, request certificates, pay expenses and register certain rights.
Some actions may still require the heir’s personal declaration of will or a special form of document. Before signing, contact the notary who conducts the inheritance case and ask for an exact list of powers.
The more precisely the text is agreed, the lower the risk of missing a deadline or facing a refusal.
Power of attorney / consent for a child’s travel
“Power of attorney for a child’s travel” is a common but not always accurate name. In most cases parents need a notarised consent for the temporary travel of a minor child rather than a classic power of attorney.
The document usually states the child’s details, the accompanying person, the countries of travel and the period for which consent is given.
Belarusian foreign missions still authenticate certain consents, including consents for temporary travel of minors outside Belarus. In that situation a Polish notarial route is not the only option — a Belarusian diplomatic mission may also be available, subject to current admission rules and document requirements.
Before arranging the document, take into account the child’s citizenship, the destination country, the travel route and the requirements of border authorities.
Power of attorney for a car
A car-related power of attorney can be used for different purposes: collecting documents, dealing with an insurer, representation before institutions or selected administrative actions.
If the plan is to sell, gift, deregister the vehicle or register a transfer of ownership in Belarus, special caution is required.
According to official information of the Embassy of Belarus, state registration of contracts on alienation of vehicles and other alienation transactions is carried out upon the owner’s personal application or on the basis of a power of attorney arranged in Belarus. A Polish power of attorney may be insufficient for such a transaction.
That does not mean a foreign power of attorney is useless. It may still support preparatory or administrative steps. The possibility of sale or re-registration must, however, be confirmed in advance with the relevant Belarusian authority.
Power of attorney for real estate
A real-estate power of attorney is especially relevant for Belarusians who live in Poland but own an apartment, house or land plot in Belarus.
Under a power of attorney the representative may collect documents, file applications, deal with utility providers and handle some administrative matters. The ability to sell, gift or otherwise alienate real estate under a power of attorney signed before a Polish notary is substantially limited.
The Embassy of Belarus indicates that state registration of contracts on alienation of real estate is carried out upon the owner’s personal application or under a power of attorney arranged in Belarus. Promises to “arrange in Poland an unrestricted power of attorney to sell an apartment in Belarus” should therefore be treated with great caution.
Before drafting, contact a Belarusian notary or the registration authority and clarify in writing which actions are allowed under a foreign power of attorney.
Power of attorney for a gift
A power of attorney for a gift deed is also linked to alienation of property. If you plan to gift an apartment, house, land plot, car or other property that requires state registration in Belarus, a Polish power of attorney may not give the representative the right to complete the transaction.
In that situation it is important to separate preparatory actions from the transaction itself. The representative may be able to collect some documents or certificates, but may not be able to sign the gift deed and register the transfer of ownership.
Before visiting a Polish notary, agree the procedure with the Belarusian notary who will prepare the gift deed.
Which actions may be restricted
A power of attorney arranged in Poland is not suitable for every procedure in Belarus.
Restrictions may concern real-estate transactions, sale or gift of vehicles, obtaining certain documents, actions that under Belarusian law require personal presence, and procedures for which only a power of attorney arranged in Belarus is accepted.
- Sale or gift of real estate that requires state registration in Belarus
- Sale, gift or re-registration of a vehicle
- Actions that require a personal declaration of will by the owner or heir
- Procedures where the receiving body accepts only a Belarus-issued power of attorney
- Broad “do everything” wording that does not match bank or notary checklists
This is one of the main reasons ONE PLUS does not start from mechanical template filling. First we check whether the task can be solved with a Polish document.
If a Polish power of attorney will not work, the client learns this before paying for notarial acts, translation and shipping of the original.
In which language should the power of attorney be prepared?
A Polish notary performs notarial acts under Polish law, so the notarial clause is drawn up in Polish.
The text of the power of attorney itself may be prepared in a Polish or bilingual version. In some cases a separate translation into Russian or Belarusian is used.
If the principal does not understand Polish well enough, a sworn translator may need to take part in the notarial act. The notary must be sure that the signatory understands the content of the document and the legal consequences of the powers transferred. ONE PLUS can help arrange sworn translation for the visit and for later use of the document.
For use in Belarus it is important to translate not only the main text, but also the notarial clause, court marks and the apostille if one was issued.
Agree the form of translation with the institution that will accept the document. Sometimes a translation prepared in Poland is enough; in other situations the Belarusian side may require a translation arranged or authenticated under local rules.
How long is a power of attorney valid?
The validity period of a power of attorney is determined by its text and by the law applied to the document.
You can set a concrete end date for the powers or link them to completion of a specific action. For a one-off task there is usually no need to issue a document for several years.
A wide open-ended power of attorney creates extra risk. If the document allows disposal of money, accounts or property, it is better to set a reasonable term and describe the limits of the powers precisely.
You should also decide whether the representative may transfer powers to another person. If substitution is not needed, state that clearly in the text.
Some banks and notaries also look at how fresh the document is. Even if the formal term has not expired, an institution may ask for a recently signed original. Clarify this before you choose a long validity period “just in case”.
Can a power of attorney be revoked?
The principal may cancel the powers granted, but an internal decision alone is not enough.
Revocation must be arranged in the proper form, the representative must be notified, and — where possible — the institutions that may have used the document should also be informed.
If the document was issued for a bank, a notary or a specific state body, clarify how that organisation records revocation.
When revoking a foreign power of attorney you may need additional documents, translation and confirmation of signature. That is another reason to avoid unjustifiably broad powers from the start.
Notary services in Poland for Belarusian citizens
notary services in Wrocław may include more than arranging a power of attorney. Depending on the situation, a Polish notary may authenticate a signature, prepare a notarised copy, arrange a statement, a consent or a notarial deed.
It is important to understand the difference between authenticating a signature and checking the legal content of the document.
If a client brings a self-prepared text, the notary may confirm that a specific person signed it. That does not always mean the text is suitable for use in Belarus and contains all necessary powers.
Therefore the document should be reviewed against the requirements of the Belarusian side before signing.
ONE PLUS works with Polish notarial practice in Wrocław and explains the practical difference between a certified signature, a notarial power of attorney and additional confirmations that some Belarusian institutions request later.
How the process works with ONE PLUS
First the client describes the task that must be solved in Belarus. We need to know not only the name of the document, but the real goal: receive money from a bank, enter into an inheritance, collect documents, represent interests before an institution or resolve a property matter.
Then we check whether the action can be performed under a power of attorney arranged in Poland. If needed, the client receives a list of questions to clarify with a Belarusian notary, bank or state body.
Next we collect data of the principal, the representative and the object, prepare the text and agree it with the client.
When the text is ready, signing before a Polish notary is organised. If translation, court confirmation of the notarial document or apostille is required, ONE PLUS helps with those stages as well — including apostille services when they are genuinely needed.
As a result the client receives not just a stamped paper, but a power of attorney prepared for a concrete task.
Tatiana Vyborna’s practical approach is to keep the client informed about risks before money is spent: if a Polish document cannot complete a sale or gift in Belarus, we say so early and discuss realistic alternatives instead of promising an impossible “full sale power of attorney from Poland”.
Why Belarusians choose ONE PLUS
The main advantage of professional support is not printing a template as quickly as possible. The goal is a document that will actually be accepted in Belarus.
ONE PLUS helps verify the purpose of the power of attorney, choose a suitable form, prepare the necessary powers and organise notarial signing in Poland.
We also explain whether translation is needed, whether apostille will be required and whether there are limits for the concrete operation.
This matters especially for banks, inheritance, real estate, cars and family matters, where one missing sentence can lead to refusal or a costly repeat of the whole process.
Clients also value clear communication in a language they understand, predictable steps in Wrocław, and coordination of notary, translation and confirmation without sending the file between several unrelated offices.
Other types of powers of attorney
On the power of attorney in Poland service page you can find general information about representation and notarial options in Wrocław.
For a broad set of powers a carefully drafted general document may be used; for banking operations a separate bank-focused text is usually safer. Gift-related cases are covered on the page for a power of attorney for a gift deed.
In family matters parents often need a notarised consent for a child’s travel rather than a classic power of attorney. Inheritance, car and real-estate files each need their own wording and their own preliminary check with the Belarusian side.
Each of these documents has its own purpose. Using one universal formula for every situation is not recommended.
How to order a power of attorney for Belarus
To arrange a power of attorney, first contact ONE PLUS and briefly describe what the representative must do in Belarus.
It is useful to name the bank, notarial office, state body or other organisation that will receive the document. If you already have a draft power of attorney or written requirements from the Belarusian side, send them for review.
After analysing the situation we will tell you whether a Polish power of attorney is suitable, which documents to prepare and whether additional formalities are needed.
This approach reveals limits early and helps avoid a situation where a signed and paid power of attorney is refused in Belarus.
You can start remotely with scans and a short description of the case, then come to the notary in Wrocław for signing once the text is agreed. If a sworn translator is needed for the visit, we plan that appointment together with the notary slot.
Summary
A Belarusian can arrange a power of attorney in Poland through a Polish notary, but the content and form of the document must match the concrete task and the requirements of the Belarusian institution.
Since September 2023 Belarusian diplomatic missions abroad no longer authenticate powers of attorney, so the Polish notarial route has become the main option for Belarusian citizens staying in Poland.
At the same time a foreign power of attorney is not suitable for every action. Especially strict limits apply to sale and gift of real estate, vehicles and other transactions that require state registration in Belarus.
The correct sequence is therefore: first clarify the receiving side’s requirements, then prepare an individual text, and only afterwards sign before a notary.
ONE PLUS helps through the whole process: from checking whether a power of attorney can be arranged in Poland to preparing the text, notarial signing, translation and additional confirmation when it is truly required.
How ONE PLUS helps Belarusians with a power of attorney
ONE PLUS is a leading agency for foreigners in Wrocław. We help Belarusians prepare a power of attorney in Poland for use in Belarus: we check what the bank, notary or state body will accept, draft the text, organise signing with a Polish notary, and arrange translation or apostille when it is truly required.
Case logic is guided by Tatiana Vyborna, a specialist in legalisation and notarised documents since 2015. Her checklist is practical: who will receive the document, which actions must be listed, which language is safer, and whether apostille plus sworn translation are needed before you travel to the notary.
- power of attorney in Wrocław tailored to the receiving institution;
- gift, property, bank and other special forms — including a power of attorney for a gift deed;
- coordination with a notary in Wrocław;
- translation and apostille only when the case needs them — no unnecessary fees;
- clear explanation of validity, revocation and risky “internet templates”.
Polish apostille guidance: gov.pl — apostille. Send documents via ONE PLUS contact for a first review before signing day.
Why Belarusians choose ONE PLUS
Clients choose us when a Belarus bank rejected a vague text, when they cannot fly home, or when several actions must fit one document without over-authorising the attorney. As a leading agency, we combine notary coordination, translation and document legalisation in one process — with plain-language explanations at every step.
Frequently asked questions
For classic powers of attorney, yes — in most cases a Polish notary is the main practical option while you stay in Poland. Belarusian missions abroad stopped authenticating powers of attorney in September 2023, although they may still handle some other acts such as certain consents or signature certifications. Always check the current rules for your exact document type.
No. Because of the bilateral legal assistance treaty, many official Polish documents can be used in Belarus without legalisation. Still, a concrete bank or notary may ask for apostille, a specific translation form or extra wording. Confirm first; then decide.
Often not for the final alienation and state registration. Official embassy guidance indicates that registration of many alienation contracts requires the owner’s personal appearance or a power of attorney arranged in Belarus. A Polish document may still help with preparatory steps — confirm this in writing before you sign.
If you do not understand Polish well enough to follow the notarial act, the notary may require a sworn translator. This protects you: you must understand what powers you grant. Translation of the finished document for Belarus is a separate step and should follow the receiving institution’s rules.
Simple files with a clear bank or notary checklist can often move quickly once data and wording are ready. Cases involving property alienation, inheritance deadlines or uncertain acceptance take longer because the first step is verification, not signing. We give a realistic timeline after the initial case check.
This material is for information only and does not replace individual legal advice. Requirements for a power of attorney must be checked with the specific bank, notarial office or state body in Belarus before signing.
