EU Long-Term Resident Status in Poland

ONE PLUS helps foreign nationals apply for EU long-term resident status in Wrocław and throughout Poland. For many people, EU long-term resident status is an important step towards a more secure future in Poland. It removes the need to renew a temporary residence permit every few years and provides a stable basis for living and working in the country.

What is EU long-term resident status?

An EU long-term residence permit is an indefinite residence status available to eligible non-EU nationals who have lived legally and continuously in Poland for the required period.

Its official Polish name is zezwolenie na pobyt rezydenta długoterminowego UE. It is different from a temporary residence permit and from permanent residence granted on the basis of Polish ancestry, marriage or other specific circumstances.

The status itself is granted indefinitely. The physical residence card is valid for five years and must then be replaced. Replacing the card is a technical procedure and does not require you to apply for the status again.

Detailed official information about the qualifying periods, permitted absences, income requirements and proof of Polish language skills is available from the Polish Office for Foreigners.

How does it differ from a temporary residence permit?

A temporary residence permit is issued for a limited period. If you want to remain in Poland, you normally need to apply for another permit before the current one expires.

Depending on the type of permit, your right to stay may also be linked to a particular employer, job, business or other purpose. A significant change in your circumstances may require a new application.

EU long-term resident status offers much greater stability. It allows you to live in Poland indefinitely, work without a separate work permit and change employers without applying for a new residence permit.

It may also make it easier to run a business, deal with banks and public authorities, and apply for family reunification. Access to healthcare, social benefits, loans and mortgages remains subject to the separate rules that apply in each case.

The status may also make it easier to move to another EU country. However, it does not provide the same freedom of movement as EU citizenship. If you want to live or work in another Member State, you will usually still need to meet that country’s immigration requirements.

Benefits of EU long-term residence in Poland

The main advantage is long-term security. You no longer need to renew a temporary residence permit every few years or worry that a change of employer will automatically affect your right to stay in Poland.

As an EU long-term resident, you can live in Poland indefinitely and work without a separate work permit. You can change employers more freely and, where permitted by law, run your own business.

The status may also provide a stronger basis for family reunification and for a future application for Polish citizenship. Although the physical card must be replaced every five years, the underlying residence permit remains valid indefinitely unless there are legal grounds for withdrawing it.

For people who do not qualify for permanent residence through Polish ancestry, marriage or another specific route, EU long-term resident status is often the most suitable way to secure their future in Poland.

Who can apply?

The main requirement is at least five years of legal and uninterrupted residence in Poland immediately before submitting the application.

You must also have a legal, stable and regular source of income, health insurance, a legal right to occupy your accommodation and proof of Polish language skills at a minimum B1 level.

Living in Poland for five years is not enough on its own. The voivodeship office will examine the legal basis of each period of residence, the time you spent outside Poland, your income history, insurance and supporting documents.

For this reason, the process should begin with a detailed review of your situation rather than simply completing the application form.

How is the five-year period calculated?

Calculating the required period is often the most difficult part of the application. Not every legal stay in Poland counts in full, and some periods may not count at all.

Time spent in Poland under a temporary residence and work permit will normally count in full. Other qualifying periods may include residence based on employment, business activity, family reunification or an EU Blue Card.

Time spent in Poland for full-time studies or vocational training is generally counted at half its actual length. For example, four years of university study may count as only two years towards EU long-term resident status.

Some short-term, diplomatic, humanitarian, intra-corporate transfer and other specific types of residence may be treated differently or excluded. The result depends on the exact legal basis shown in your visas, residence decisions and previous permits.

Before preparing an application, we reconstruct the client’s full residence history and determine the earliest safe date for submission.

How long can you stay outside Poland?

The five-year residence period must be continuous, but this does not mean that you cannot travel abroad.

Under the general rules, a single absence should not exceed six consecutive months. Your total time outside Poland should not exceed ten months during the relevant five-year period.

Different limits may apply to certain EU Blue Card holders. In these cases, a single absence may be allowed for up to 12 months, while the total period spent outside Poland may be up to 18 months.

In limited circumstances, time spent abroad may still be treated as part of your residence in Poland. This can apply, for example, when travel was connected with work for a Polish employer, a serious personal situation, medical treatment unavailable in Poland or an internship required as part of studies in Poland.

Travel dates should be checked carefully against passport stamps, tickets and other available records. Even a small error may change the date on which you become eligible to apply.

Income requirements

The voivodeship office does not look only at whether you have a job when you submit the application. It examines whether your income has been legal, stable, regular and sufficient over a longer period.

For most applicants, income is assessed for the three years immediately before the application. For certain highly qualified employees, including eligible EU Blue Card holders, the relevant period may be two years.

Your income does not need to be exactly the same every month. However, the documents should show reasonable continuity and financial stability. The office must be satisfied that you can support yourself and any dependent family members without relying on social assistance.

Income is commonly documented with employment contracts, annual PIT tax returns, employer certificates, salary confirmations, ZUS records and bank statements. Business owners may also need accounting records, invoices, tax documents and evidence that the business is genuinely active.

Before submitting the application, we compare the amounts shown in employment documents, PIT returns, ZUS records and bank statements. Any inconsistency should be identified and explained in advance.

Proof of Polish language skills

Applicants must normally prove that they speak Polish at a minimum B1 level.

The most common form of evidence is a B1 certificate issued through Poland’s official state certification system. A diploma from a Polish school or university may also be accepted if Polish was the language of instruction.

A certificate issued by a private language school is not automatically sufficient. Polish law provides a specific list of accepted documents, so your certificate or diploma should be checked before the application is filed.

Children under the age of 16 are not required to provide proof of Polish language skills for this procedure.

Documents required for the application

The exact set of documents depends on your residence history and personal circumstances. A standard application usually includes a valid passport, a completed application form, photographs, proof of payment, health insurance and evidence of your legal right to occupy your home.

You will also need documents covering the five-year qualifying period. These may include previous residence cards, residence decisions, visas and records of travel outside Poland.

Income is usually documented with employment contracts, PIT returns, employer certificates, ZUS records, salary confirmations and bank statements. If you run a business, the office may also require accounting records, invoices and company documents.

You must also submit an accepted B1 language certificate or another recognised document, unless an exemption applies.

The voivodeship office may request additional evidence if the documents do not fully explain your residence history, income, insurance, accommodation or periods spent abroad.

Why are applications refused?

Many refusals result from incorrect calculations or incomplete evidence rather than a complete lack of eligibility.

An applicant may believe they have lived in Poland for five years without realising that part of their student residence counts only at half its length. Someone else may overlook a long trip abroad or submit income documents that do not match their PIT returns and ZUS records.

Problems may also arise when the applicant provides an unacceptable language certificate, cannot prove a legal right to their accommodation or fails to document health insurance properly.

In some cases, the application is simply submitted too early. Waiting a few months, improving the income history or collecting missing evidence may be safer than applying immediately and risking a refusal.

EU long-term resident status and Polish citizenship

EU long-term resident status can provide a strong basis for a future application for Polish citizenship.

Citizenship is not granted automatically. Applicants must still meet separate requirements concerning the length and continuity of their residence, income, accommodation, Polish language skills and other relevant circumstances.

In many cases, however, obtaining EU long-term resident status is an important step towards applying to be recognised as a Polish citizen in the future.

Do I need a B1 Polish language certificate?

Most applicants must prove Polish language skills at a minimum B1 level. This can usually be done with an official state certificate or a diploma from a school or university where Polish was the language of instruction. A certificate issued by a private language school may not meet the legal requirements.

Is EU long-term resident status permanent?

Yes. The EU long-term residence permit in Poland is granted for an indefinite period. The physical residence card is valid for five years and must then be replaced, but replacing the card does not require a new application for the status itself.

How much does legal assistance with the application cost?

Full legal support costs PLN 2,700 net. It includes an eligibility review, calculation of qualifying residence periods, examination of absences, income and documents, preparation of the application, communication with the voivodeship office and assistance throughout the proceedings.
