Expired Residence Card in Poland: What to Do in 2026
13.10.2026

Your Polish residence card has expired. Does that mean you are staying in Poland illegally? Not necessarily. An expired karta pobytu and an expired right to reside are not always the same thing. The answer depends on your type of permit, whether you filed a new application while your stay was still lawful, and whether another legal basis applies.

This guide explains what to check first, how Poland’s new MOS application system works in 2026, whether you can keep working, and what happens if you need to leave Poland before your new card arrives. It also covers permanent residence cards, EU long-term residents, refused applications and special rules affecting some Ukrainian nationals.

The key distinction is between your residence status and the physical card that records it. Getting that distinction right is more useful than finding a generic answer to “how long can I stay after my card expires?”

Is an expired karta pobytu the same as illegal stay?

No. A Polish residence card is an identity and residence document. The permission behind it may be time-limited or indefinite, and other lawful grounds for staying in Poland may exist.

What has happened? What it may meanWhat to do next
Your temporary residence card expired after you filed a new application on timeYour stay may remain lawful while the application is processed, provided the legal conditions are metCheck the filing confirmation and any requests from the office
Your temporary residence permit expired and you did not apply againYou may have no lawful basis to remain, unless another one appliesEstablish the precise end date of lawful stay
Your permanent residence card expiredPermanent residence permission is indefinite; the card is notApply for a subsequent card
Your EU long-term resident card expiredThe permit is indefinite, although the card has a fixed validity periodArrange a replacement card under the relevant procedure
You received a refusal or return decisionThe legal outcome depends on that decision and any other residence rightsCheck the service date and appeal deadline

A useful starting point is the administrative decision, known in Polish as the decyzja, on which your card was issued. The date on the plastic alone cannot establish your full immigration position.[1]

The documents to check before taking any action

If your card expired recently, put together a small case file. You do not need to guess which application to submit before you know what has happened.

  • Passport and residence card: confirm the document category and validity dates.
  • Voivode’s decision: identify the permit and any relevant conditions.
  • Previous applications: establish whether, when and how a new application was submitted.
  • MOS records: save the UPO electronic receipt and the separate application certificate if available.
  • Official correspondence: look for requests to correct deficiencies, refusals or decisions from the Border Guard (Straż Graniczna).
  • Other residence grounds: check any valid visa, special statutory provisions or a different residence entitlement.

Pay particular attention to when letters were actually delivered. In administrative proceedings, the date a decision reaches you may be more important than the date printed on its first page.

My residence card expired, but I applied for a new permit on time

This is a common and potentially manageable situation. Under Articles 105 and 108 of Poland’s Act on Foreigners, where an application was filed during lawful stay and meets the relevant formal conditions, or those deficiencies were corrected in time, the applicant’s stay is considered lawful from filing until the decision becomes final.[2]

Consider a straightforward example. Your temporary residence permission runs until 30 November. You submit a properly signed application through MOS in October. The old card can expire while your case remains pending without automatically making your stay unlawful, assuming the statutory conditions are satisfied.

That protection has limits. It does not keep the expired card valid, give everyone unrestricted access to employment, or replace the documents needed for international travel.

UPO versus the MOS application certificate

After a successful electronic submission, MOS issues an UPO (Urzędowe Poświadczenie Odbioru). Think of this as evidence of electronic delivery. It is important, but it does not, by itself, prove that every condition for lawful stay has been met.

Following the office’s verification of the application, you may download a separate zaświadczenie potwierdzające złożenie wniosku, a certificate confirming the submission of the application. Under the 2026 electronic procedure, it replaces the passport stamp previously used for this purpose.[3]

A saved draft, even one with all fields completed, is not a filed application. Check that the form was signed and sent, and keep your UPO.

What if the residence permit expired before I applied?

This is more serious. If the period of lawful stay has ended, no other residence basis exists, and no qualifying application was filed in time, the person may be staying in Poland unlawfully.

There is no general seven-day or 30-day grace period that automatically follows every expired temporary residence permit. Deadlines that may apply after particular final administrative decisions are different rules and should not be confused with an extension of a permit.

Sending an application late does not retrospectively legalise the days already spent without a right to stay. It also does not automatically give the same protection available to someone who applied while their stay was lawful. Depending on the permit category, an unlawful status may create further obstacles.

What about a one-day overstay?

Even one day can matter if it truly follows the last day of lawful residence. The first question is still whether a different legal basis existed. Do not assume that a small overstay is automatically excused.

What about a month or several months?

The longer the gap, the more important it becomes to reconstruct the history of residence, applications and decisions. But length alone does not establish that a re-entry ban, removal order or Schengen Information System alert has been issued.

If you discover a gap, avoid trying to “fix” it with a random MOS application. Have the status and legal options reviewed first.

Applying for a new Polish residence permit through MOS in 2026

A major procedural change took effect on 27 April 2026. Applications for temporary residence, permanent residence and EU long-term resident status are, as a general rule, submitted electronically through the official MOS portal. Paper submissions reaching voivodeship offices after the change do not count as valid new filings in these categories. Certain specific procedures remain exceptions, so the electronic-only rule should not be applied indiscriminately.[4]

If you need a new permit, ONE PLUS offers help with preparing a residence application through MOS.

A normal MOS application involves these steps:

  1. Select the permit that matches your current circumstances, not simply the permit you held in the past.
  2. Create an account in the new MOS platform, even if you used the former version.
  3. Sign in through login.gov.pl, complete the form and upload the required documentation.
  4. If your category requires an employer, university or other institution to sign an electronic attachment, obtain that attachment before final submission.
  5. Attach proof of the applicable government payments.
  6. Sign the application electronically using an accepted method and submit it.
  7. Save the UPO, the filed application and any later certificate.

The applicant must personally perform the required account and signature steps, except where legislation permits action by an appropriate legal representative. An ordinary attorney or consultant cannot simply sign a competent adult’s MOS application using their credentials.[5]

After filing, the voivodeship office can summon you to show your original passport, provide fingerprints and a signature specimen, or supply further documents. MOS is not a complete messaging service for all case correspondence. Monitor the address designated for official delivery and respond to letters within the stated deadlines.[3]

Can I keep working after my residence card expires?

Legal residence and the right to work are separate legal questions. This is one of the most common points of confusion for people with temporary residence and work permits.

The documents for an employment-based application are explained in our residence permit based on work service.

A timely residence application does not automatically authorise every kind of employment. The answer depends on your previous employment entitlement, the type of permit or exemption involved, your employer, and whether your work conditions have changed.[6]

For example, the situation may be different if you remain with the same employer under an applicable legal basis than if you have changed employers while your new residence application is pending. Review both the residence position and the labour authorisation before starting work under new conditions.

Why the employer’s MOS attachment matters

For a temporary residence and work application, the employer completes and electronically signs a dedicated attachment. The applicant provides the employer’s email address, and the system sends a link to the relevant form.

If that mandatory attachment is not completed, the application cannot be finalised.[7] Waiting until the last few days of lawful stay can therefore be risky even if your own documents are ready.

Can I travel with an expired Polish residence card?

Do not rely on an UPO or MOS application certificate as a travel document. The certificate does not itself authorise travel around the Schengen Area or guarantee re-entry to Poland.[8]

You may need a valid visa or to satisfy all the requirements of visa-free entry to return. What is possible depends on nationality, travel history, existing documents and the applicable entry rules.

A short trip to Germany or the Czech Republic is not automatically permitted simply because your pending application lets you remain in Poland. Nor should you assume a visit to your home country will be followed by an uncomplicated return.

Check re-entry requirements before booking flights or leaving Poland, especially if your expired card was previously the document you used for border crossings.

Permanent residence and EU long-term residence: a different rule

A Polish permanent residence permit (pobyt stały) is indefinite, while its physical card is normally valid for 10 years. An EU long-term resident permit is also indefinite, while its card is generally issued for 5 years.[1]

If you are planning to obtain this status, review the requirements for EU long-term residence in Poland.

If only the card has expired, it does not mean the underlying indefinite permission disappears. You need to request a subsequent card, not apply again for the same indefinite permit solely because the plastic expired.

Official MOS guidance says an application for the next card should be made 30 days before the current card’s expiry.[1] Issuing that next physical card is a different administrative process from applying through MOS for a new residence permit.

What does a new application cost in 2026?

Government charges depend on the legal basis. Typical stamp-duty amounts include PLN 340 for standard temporary-residence categories, PLN 440 for a common temporary residence and work application, and PLN 640 for permanent residence where the standard fee applies. The standard residence-card issuance charge is PLN 100. Exemptions and category-specific fees may apply.[9]

Under the 2026 MOS process, proof of the relevant stamp-duty payment and the separate card fee must be attached when applying. The fees go to different designated accounts and cannot be paid inside MOS.

Translation fees, photographs, document collection and professional assistance are separate costs. Always verify the current payment details with the appropriate voivodeship office.

Refusals, appeals and possible consequences of unlawful stay

Unlawful stay can lead to proceedings before the Polish Border Guard. Depending on the decision, there may be a return obligation and, in relevant circumstances, a re-entry ban. An expired card on its own is not an automatic deportation order or SIS alert.

For a review of the decision and deadlines, see our residence permit appeal service.

If a voivode refuses a residence permit, the usual appeal deadline is 14 days from service of the decision. Appeals are lodged through the authority that issued the decision and addressed to the Head of the Office for Foreigners (Szef Urzędu do Spraw Cudzoziemców).[10]

If the Border Guard issues a return decision, the ordinary appeal deadline is seven days from service. This is a separate process from a residence application in MOS.[11]

Those short deadlines make it essential to retain the envelope, delivery confirmation or electronic proof of service when an official decision arrives.

Ukrainian nationals: expired cards and special rules in 2026

Special provisions can change the answer for Ukrainian nationals. Polish legislation has extended the validity of certain documents and periods of lawful stay until 4 March 2027, subject to the relevant conditions. Separately, EU temporary protection was extended until 4 March 2028.[12]

The separate UKR transition route is explained in our CUKR card service.

These are different legal mechanisms. The EU temporary-protection date does not make every Polish residence card valid until March 2028. Individual circumstances, PESEL UKR status, the type of document and any CUKR procedure need to be assessed separately.

The same distinction applies to travel: a special rule preserving residence rights does not necessarily mean an expired physical card can be used at a border.

Frequently asked questions

Short answers to questions that most often come up in similar cases.
Can I stay in Poland after my residence card expires?

Possibly. A valid alternative residence basis, an indefinite permit or a properly filed and qualifying pending application may allow lawful stay. The expired card alone does not answer the question.

Is there a 30-day grace period after an expired Polish residence permit?

There is no general grace period that applies to every temporary residence permit. Do not confuse other statutory departure deadlines with permission to apply late.

I applied on time but have not received a new card. Am I an overstayer?

Not automatically. If the application and residence conditions under the Act on Foreigners are met, your stay may remain lawful until the decision becomes final.

Can my employer apply for my next residence card for me?

An employer may have mandatory tasks in the procedure, but the adult applicant must complete the legally required personal account and signature steps in MOS.

Can I change employers while waiting for a new card?

Only after checking how the change affects your permission to work and your residence application. Pending residence status does not authorise unrestricted employment.

Can I fly home and re-enter with the MOS certificate?

The certificate alone is not a re-entry document. You need an independent legal basis for entry and must meet the relevant conditions.

Do I need a new permanent residence permit if my card is expired?

No, not merely because the card has expired. An indefinite permit and a time-limited physical card are different things.

Does an expired card automatically lead to a Schengen entry ban?

No. A ban requires a distinct legal basis and relevant administrative action. An expired card does not automatically establish that such a decision exists.

If your residence card is about to expire or is already out of date, start with a review of your actual residence status. Contact ONE PLUS to discuss the documents and legally available steps.
