ONE PLUS prepares real-estate powers of attorney in Wrocław for selling or buying an apartment, house or land, managing property and carrying out other acts through a representative. We do not simply fill in a universal template. We first establish where the property is located, what transaction the representative must complete and what limits the principal wants to place on that authority.
For Polish real estate, the form of the POA is legally important. Where a transaction requires a special legal form, the authority to carry out that transaction must follow the corresponding form. A transfer of ownership of Polish real estate requires a notarial deed, so a generic authorisation to “represent my interests” is not a substitute for a properly structured POA for the transaction.
The ONE PLUS team works with notarial powers of attorney every day. In real-estate matters we check not only personal details but also PESEL, the basis of ownership, land and mortgage register number (księga wieczysta), precise property identification, price or negotiation limits, settlement arrangements and the representative’s specific powers.
A Polish notary attends at the ONE PLUS office in Wrocław. Once the draft has been agreed, the notarial stage of a straightforward case often takes around 15 minutes. For documents intended for foreign use, we recommend checking the receiving side’s requirements in advance and considering an apostille. ONE PLUS can coordinate Apostille Services in Poland and document translation.
When is a real-estate POA needed?
Selling an apartment, house or land
A representative may be authorised to conclude the transaction, appear before a notary and public authorities, transfer documents and keys, file applications and perform other agreed acts connected with the sale.
We also establish whether the representative may negotiate the price and terms independently or must remain within limits set by the owner.
Buying property through a representative
The authority may cover purchasing a specified property or acting within defined parameters, signing preliminary and final documents, making payments, collecting keys and completing related steps.
Managing property
Not every real-estate POA is for a sale. It can cover specific management tasks, obtaining documents, dealing with building administration, entering into defined agreements and representation before institutions.
Property outside Poland
A common ONE PLUS scenario is an owner living in Poland while the apartment, house or land is in Ukraine or another country. The document then needs to account for both Polish execution formalities and the requirements of the jurisdiction where it will actually be used.
Why a general POA may not be enough
The form must match the transaction
Under Polish civil law, a POA for an act requiring a special legal form must be granted in that form. A transaction transferring ownership of real estate requires a notarial deed.
The property must be identified accurately
Depending on the matter, we check the address, land and mortgage register number, cadastral or other identifying information and documents showing the basis of ownership.
The authority must reflect the real transaction
The words “sell the property” may not resolve practical questions about price, settlement, documents, keys, banking matters or specific declarations that the representative must make.
POA to sell real estate in Poland
Land and mortgage register and basis of ownership
For Polish property, we normally request the księga wieczysta number where one exists and information showing how the principal acquired the right, such as a notarial deed, inheritance documentation, court decision or another relevant instrument.
Price and negotiation limits
The principal may set a fixed price, minimum price or other limits. Broader discretion can also be granted. The important point is that the scope is deliberate and reflected clearly in the wording.
Receiving the sale proceeds
Authority to sign a sale and authority to receive money are treated as separate practical issues. If the representative must collect the price, acknowledge settlement or deal with the funds, we address this expressly.
Handover of the property
Where needed, the POA can cover handover of the apartment or house, keys and documents and signing a handover protocol.
POA to buy real estate in Poland
A specified property or authority to choose
If the property is already selected, it can be identified precisely. If the representative is expected to select a property, the limits of that discretion should be clear.
Preliminary agreement, deposit and price
We establish whether the representative may sign preliminary documents, pay a deposit or advance and negotiate the purchase price.
Final notarial deed and follow-up acts
The authority can cover concluding the final transaction, collecting documents and keys and making the declarations required for the particular purchase.
Real-estate POA for use in Ukraine
Send the Ukrainian notary’s requirements
If a Ukrainian notary, registrar, bank or other receiving party has supplied a draft or list of required powers, send it to ONE PLUS before we prepare the Polish document.
Consider apostille before signing
For documents intended for foreign use, ONE PLUS recommends considering an apostille in advance rather than dealing with authentication only after the document has been sent abroad.
At the same time, Poland and Ukraine have a bilateral legal-assistance treaty under which official documents are recognised without legalisation. An apostille therefore should not be described as mandatory in every case. The practical approach is to check the requirements of the specific Ukrainian notary or institution. If an apostille is requested or is useful for broader international use, ONE PLUS can coordinate obtaining it.
An apostille is issued by the competent public authority; ONE PLUS coordinates the process rather than issuing it itself.
Translation
Language and translation requirements depend on the receiving side. Where required, we can coordinate an appropriate official translation.
Real-estate POA for another country
Destination matters
Requirements for form, wording, apostille, legalisation and translation vary significantly between jurisdictions.
A receiving notary’s template is useful
If a foreign notary or registrar has provided its own wording or checklist, it should be reviewed before the document is signed in Poland.
What powers can be included?
Depending on the transaction, the representative may be authorised to:
- sell or buy specified real estate;
- sign preliminary and final agreements;
- negotiate price within defined limits;
- pay or receive a deposit or advance;
- make or receive settlement where expressly authorised;
- obtain and transfer documents;
- collect or hand over keys;
- sign a handover protocol;
- file applications and declarations;
- obtain extracts, certificates and decisions;
- act in matters concerning the land and mortgage register;
- deal with a bank within an expressly defined scope;
- perform other specifically identified acts.
We do not automatically insert the broadest possible powers. With real estate, the scope should reflect the principal’s actual intention.
What documents and information are needed?
We normally ask for the principal’s identity document, PESEL where relevant, accurate representative details, the property’s address and description, Polish land and mortgage register number, basis of ownership, intended price limits, destination country and a description of the representative’s tasks.
More than one property
Tell us about every property in advance so each can be checked and described separately.
Co-owners
Co-ownership can affect both the transaction and the required documentation.
Property acquired by inheritance or gift
Provide the available documents showing the basis on which the property was acquired.
Why an online template can be risky
The property is described too generally
The identification may be insufficient for the intended transaction.
Price restrictions are missing
If the owner wants a minimum sale price, that limitation needs to be expressed in the POA.
Settlement is unclear
Signing the transaction and receiving the money are distinct practical powers.
Foreign-use requirements were ignored
A draft prepared only for Polish practice may need material changes before a foreign notary can use it.
How the ONE PLUS process works
Step 1. We analyse the transaction
We establish the property, country, type of transaction and representative’s role.
Step 2. We verify the information
We check the parties, PESEL, land and mortgage register, basis of ownership and other relevant details.
Step 3. We define the limits of authority
We discuss price, settlement, documents, keys and required declarations.
Step 4. We prepare the draft
The client receives the wording for review before signing.
Step 5. We arrange notarial signing
A Polish notary attends at the ONE PLUS office in Wrocław.
Step 6. We coordinate apostille and translation
For foreign use, we plan the next documentary steps before the POA is sent abroad.
How long does it take?
Once the draft has been agreed, the notarial stage of a standard POA often takes around 15 minutes. Additional time is required for multiple properties, unusual powers, foreign requirements, apostille or translation.
How much does a real-estate POA cost?
According to the current ONE PLUS service description, the price starts from PLN 400. The final cost depends on complexity, the number of properties and representatives, the scope of authority and additional international formalities.
ONE PLUS expertise in real-estate POAs
Daily work with notarial powers of attorney
Regular work with these documents helps us identify issues that often emerge only when a transaction is already underway: inaccurate property descriptions, missing or excessive authority, absent price limits, unclear settlement arrangements or foreign requirements discovered too late.
We analyse the transaction, not only passport details
Our review covers the property, land and mortgage register, basis of ownership, price, settlement and the representative’s role.
Polish legal preparation and notary in one process
Under the ONE PLUS service model, the draft is prepared with the involvement of a Polish lawyer and a Polish notary attends at our Wrocław office, allowing the drafting and signing stages to be coordinated in one place.
Cross-border document experience
We regularly work with foreign clients and documents intended for use outside Poland. That is why destination, apostille, translation and the receiving notary’s requirements are discussed before signing.
