Register a JDG

JDG registration for foreigners with a pre-check of legal grounds, PKD codes, address and tax form before filing in CEIDG

ONE PLUS helps foreign nationals register a JDG (sole proprietorship) in Poland and first checks whether their residence status permits this form of business activity. We identify the correct registration route, select PKD codes that reflect the actual work and prepare the information required for the CEIDG-1 application.

Support can include obtaining a PESEL number, CEIDG registration, choosing a tax regime with an accountant, ZUS and VAT registrations, and arranging a business account and bookkeeping. If the JDG is intended to support a future residence permit application, we check both procedures for consistency from the outset.

The client receives a structured launch plan and a clear list of post-registration duties. This helps avoid registering without the required entitlement, selecting unsuitable PKD codes or choosing a tax regime that does not fit the actual business.

What JDG means for a foreigner in Poland

In Poland, a sole proprietorship is called działalność gospodarcza, usually shortened to JDG. It is often the fastest way to run a small business legally: no share capital, registration through CEIDG and a choice of tax models. For many foreigners, JDG can be a practical step from employment or B2B contracts toward independent work. It is not, however, an automatic residence solution.

ONE PLUS has worked with foreigners and entrepreneurs since 2018. From our office in Wrocław we support clients across Poland. Before anyone fills in CEIDG-1, we look at the legal basis for business activity, the need for PESEL, the right PKD code and whether JDG fits a wider plan for a business-based residence permit.

The information below is general. Final requirements depend on citizenship, residence status, business type and the rules in force in 2026.

Who can register JDG in Poland

The right to run a sole proprietorship is linked to your residence status, not only to the fact that you live in Poland. In practice, JDG is commonly opened by:

  • Polish and EU citizens;
  • holders of a temporary residence card where the law allows business activity;
  • holders of a permanent residence card or EU long-term resident status issued in Poland;
  • holders of the Pole's Card;
  • spouses of Polish citizens when their stay basis allows entrepreneurship;
  • people with humanitarian status, including temporary protection;
  • Ukrainian citizens with PESEL UKR under the applicable rules;
  • participants in programmes such as Poland Business Harbour, when their status permits it.

A tourist visa or short stay without the right to conduct business activity is usually not enough. In that case, the residence strategy must come first, then CEIDG.

JDG or a limited company

JDG works well for freelancers, IT specialists, consultants, small trade and service businesses. A limited company may be better when you need share capital, several founders or a more complex structure. With JDG, the owner is liable with all personal assets. For some foreigners, the choice also affects how the office later reviews a residence case based on business activity.

PESEL, address and filing route

Why PESEL matters

Online JDG registration almost always requires a PESEL number. Without it, filing through biznes.gov.pl is usually impossible. PESEL is issued by the local commune or city office on the basis of legal stay. If the number is missing, that step should be completed before CEIDG.

Business address vs virtual office

CEIDG asks for a correspondence address and, where relevant, a fixed place of business. For many activities, a home address is acceptable. If there is no permanent workplace, entrepreneurs often use a virtual office address for mail and registration. That helps with paperwork, but it does not replace sector rules, licensing requirements or the need to show real business activity in a residence case.

Online or in person

You can register:

  • online in CEIDG with a trusted profile or qualified electronic signature;
  • in person at a city or commune office that accepts the application.

In 2026, online registration is usually faster, but only if PKD, tax form, address details and ZUS information are ready in advance.

Main steps to register JDG in CEIDG

Choose the right PKD

The PKD code defines the type of activity and affects the ryczałt rate if you choose that tax model. A wrong code creates accounting and tax problems later, sometimes already after the first invoices.

Pick a tax form

The three main options for JDG are:

  • Skala podatkowa (progressive 12% and 32%, costs may reduce tax, joint filing with a spouse is possible);
  • Podatek liniowy (flat 19% regardless of income, costs may be deducted);
  • Ryczałt od przychodów ewidencjonowanych (fixed rate from 2% to 17% depending on PKD, no cost deduction).

The best choice depends on margin, fixed costs, planned revenue and whether your clients require VAT invoices. It is easier to decide before registration than to fix the setup later.

Register with ZUS

After opening JDG, the owner must register with ZUS. Deadlines, contribution levels and possible reliefs such as Mały ZUS Plus depend on the individual situation. Missing or incorrect ZUS registration often appears later during bank onboarding, tax review or a business residence application. Current rules are published on zus.pl.

VAT and business bank account

Not every sole proprietor must become an active VAT payer immediately. If you sell mostly to private clients and stay below the exemption limits, you may start as VAT exempt. If you invoice VAT-registered companies, export services or exceed the thresholds, VAT registration becomes necessary or commercially sensible. The VAT-R form goes to the tax office.

A separate business bank account is not always legally required from day one, but in practice it is needed for contracts, payouts, accounting and proof of turnover in migration cases.

JDG and a residence card: what officials look at

Opening JDG does not by itself create a residence right. But if you plan to apply for temporary residence based on business activity, the office will assess whether the business is real: contracts, invoices, ZUS contributions, tax compliance and a credible development plan. CEIDG entry alone is not enough.

A common mistake is to register JDG only for formality, generate little or no revenue and then expect a positive residence decision. Officials look at the whole economic picture.

How ONE PLUS supports JDG registration

We do not replace state authorities and cannot guarantee CEIDG processing time or a residence decision. We can, however, reduce the risk of costly mistakes:

  • verify whether you have the legal right to open JDG;
  • help choose PKD and the tax form;
  • prepare CEIDG-1 data and support online filing;
  • explain ZUS and VAT obligations;
  • advise on a business bank account;
  • connect you with ongoing tax support if needed;
  • review how JDG fits a wider business residence plan.

We have been on the market since 2018 and work with foreigners, employers and entrepreneurs throughout Poland.

Mistakes we see most often

Registering without the right to run a business

CEIDG may refuse the entry, and residence problems may follow later.

Wrong PKD or tax model

Ryczałt with high costs, or progressive tax without using deductible expenses, often leads to overpayment.

Ignoring ZUS

Missing registration or unpaid contributions complicate accounting, banking and residence files.

Mixing private and business money

Without clear payments, it is harder to prove income and keep the file clean for officials.

Address used only as a formality

A virtual address helps with mail, but it does not replace real sector requirements or proof of genuine activity.

Frequently Asked Questions

Answers to common questions about the procedure, documents, and ONE PLUS support
Can I open JDG in Poland without a residence card?

Sometimes yes, if you have another legal basis such as EU citizenship, PESEL UKR, the Pole’s Card, permanent stay or another status that gives the right to conduct business activity. A tourist or short-term stay is usually insufficient.

How long does CEIDG registration take?

With complete data, online registration often takes one business day. Additional documents, translations or in-person filing can extend the timeline.

Is PESEL UKR enough for Ukrainian citizens?

For many Ukrainian citizens, the right to JDG is linked to legal stay under special rules, including PESEL UKR. The exact answer depends on the date of status assignment and the rules applicable in 2026.

When do I need VAT registration?

When you work with VAT payers, export services or exceed exemption limits. It is better to decide before issuing the first invoices.

Can I use my home address for JDG?

In many cases yes, if the activity allows it and the lease does not restrict it. Licensed or regulated activities may require another premises.

What is the difference between JDG and B2B?

JDG is your own business entry in CEIDG. B2B is a contract under which you invoice another company as a contractor. Many foreigners start with B2B and open JDG later when income and status allow it.

Does JDG guarantee a residence permit?

No. But with the right stay basis and real activity, JDG may support an application for temporary residence based on business activity. The final decision always belongs to the office.

What should I do immediately after JDG registration?

Check the CEIDG entry, register with ZUS, decide on VAT, open a business account, set up accounting and keep every contract and invoice from day one.

We applied to One Plus for registration as a sole proprietorship. Later we applied for permanent residence. Collecting the documents did not take long. We submitted the application at the beginning of December, and the document was issued at the beginning of June. Everything went quickly and smoothly. Now we are waiting for our plastic card.

The best company that will bring a case to a positive outcome, help you obtain compensation from unfair inspectors and provide competent advice to Wroclaw entrepreneurs. I submitted an application in 2019, the inspector changed 3 times, I received compensation of 2400 zloty and a decision on business activity. And all thanks to One Plus and Tatiana, who handled my case from the very beginning. Without any additional fees, the compensation turned out to be higher than the cost of the service. Thank you for the "walk" with the office and for the professionalism of the whole team!
