
Estates run on deadlines, and a POA organizes the path
An inheritance case in Poland combines deadlines, identity documents, civil status records and often cross-border elements when the deceased or heir lived abroad. An inheritance POA lets the heir appoint someone to submit a statement, collect documents or handle preparatory steps. It does not replace the heir’s decision to accept or reject the estate, but it supports formal steps when personal appearance is impossible.

What an inheritance POA covers
Statement mandate vs preparatory acts
An inheritance POA may authorize acceptance or rejection of the estate if the wording is precise and the notary accepts it. It may also cover preparatory acts only: collecting drafts, filing applications, obtaining death certificates or foreign documents.
The difference matters in practice. Accepting an estate may expose the heir to debts. The agent must not exceed scope, or the act may be invalid or require repetition.
Notarial form
A POA for an act that itself requires notarial form usually must also be notarial. Acceptance or rejection before a notary is a special-form act. The POA for that step must meet the notary’s requirements.
General POA vs inheritance POA
A general property POA does not replace an inheritance POA. The notary expects wording that safely supports the specific inheritance step.
When an inheritance POA makes sense
Heir lives abroad
The most common scenario: the heir cannot travel to Poland in time for a notary statement. An agent in Poland may represent the heir within granted powers if the notary accepts the POA.
Limited mobility or health
When the heir cannot appear on schedule, a POA may enable a statement or preparatory acts. Inheritance deadlines can be short, so act quickly without sacrificing document quality.
Multi-party family cases
Several heirs, assets in Poland and abroad, mixed legal documents: an inheritance POA may be one part of a wider plan. Bank POAs or property sale mandates for estate assets may follow.
Linking PESEL and registration
A foreign heir often needs a PESEL number or residence registration (zameldowanie) before notarial steps. Plan those steps in order.
PESEL, identity and documents
PESEL number
Polish notaries and offices expect PESEL where the person can obtain it. A foreign heir without PESEL is often asked to apply first because identification in inheritance steps becomes easier.
If the heir is still settling in Poland, consider PESEL registration before scheduling the notary.
Estate and civil documents
Death certificate, civil status extracts, will if any, documents proving kinship. Foreign papers often need sworn translation and legalization. The notary assesses completeness.
Agent selection
The agent should be trusted and aware of legal consequences. Legal training is not required, but scope limits must be respected.
Inheritance POA vs other mandate types
An inheritance POA does not replace a POA to sell estate property or a bank POA for inherited accounts. After acceptance, further steps may appear: land register entry, asset division, tax declarations. Each stage may need a separate POA or precise scope extension.
Lifetime gifts follow different rules than inheritance after death. An inheritance POA concerns post-death procedure, not earlier property acts.

Wrocław has many notaries. Choice belongs to the parties, but preparation reduces visits and formal refusals.
POA created abroad
When the heir lives outside Poland, the POA may be created at a Polish consulate or before a local notary abroad. The Polish notary handling the estate will assess form and legalization.
This is rarely a one-day process. Translation, apostille or superlegalization may be required. Each country has its own rules, and a wrong document delays the case by weeks.
Common mistakes before the notary visit
Wording that is too general
The notary may refuse if the POA does not show which inheritance act it covers. Prepare estate data and draft scope early.
Ignoring deadlines
Acceptance or rejection statements have statutory deadlines. A POA does not automatically extend them. Coordinate dates with the notary quickly.
Inconsistent personal data
Different name spellings or birth dates across passport, registration and civil records cause classic delays. Align data in the office first.
Confusing POA with a will
A will expresses the testator’s wishes. An inheritance POA authorizes the heir to act. They are different documents with different effects.
Relying on family verbal agreements
Oral family statements do not replace notarial acts or POA. Formalization protects parties but takes time.
